Car stolen with spare key in it

    If you can prove that the spare key wasn't used to steal the car then I'd say fight your case. For example if the main key was burgled from your house and you have evidence of that. Otherwise you're not getting anything back. The exclusion is common and will be in your insurance policy booklet, it's your responsibility to read and understand that.
    (In the rare case the exclusion ISN'T in your policy documents, then of course fight your case.)
    The car salesperson gave you bad advice, but it wasn't directly related to the car purchase, so I strongly doubt they have any liability.
    All you can do is hope the car is recovered.

    The OP says that he was at home at the time and the car was parked a little way from the house, so it seems unlikely any keys were taken from their house, and I bet the thief could not believe their luck in finding the spare in an unlocked glove compartment.

    If the car has keyless entry it's possible that it didn't lock properly because the spare fob was in the car.  We were warned about that both by the dealership and it's mentioned in the owner's handbook.  Irrespective of that, if the insurance policy states that they won't pay out if the key is left in the car, I don't see that the OP has any claim.

    Oh yes, that’d make sense. Completely idiotic advice of course if by this he means so that the car can be started without the fob.

    That's my thoughts as well. Brand new car, keyless entry. Spare fob in glovebox. Doors not locked. Thief opens door gets in pushes start button. Has a good laugh and drives away.
    Op hope you get your car found, but if above then lesson learned?
