30 day rejection
I received a new vehicle on 25th October last year and a fault developed within the first few days and I informed them I was rejecting the vehicle. .Although the supplier accepts that I have rejected the vehicle and finally, after much messing around will be collecting the vehicle and will refund my deposit and 1 months finance agreement they wish to charge for the use of the vehicle. I am wanting to be reasonable however the Consumer ACt 2015 states a full refund as it is not my fault they have taken this long to sort everything out to finally accept the vehicle back but would I be unreasonable standing my ground and wanting the full amount returned.

CRA15 allows for a reasonable deduction for use. One month's finance payment is probably excessive for a few days use. But they don't have to collect, unless they delivered - so it would be reasonable to deduct a fair amount for that.

Not within the 30 days short-term right to reject period it doesn't.AdrianC said:CRA15 allows for a reasonable deduction for use. One month's finance payment is probably excessive for a few days use. You need to remind them that as you're exercising your short-term right to reject a full refund is forthcoming. The fact that it's taken this long is neither here nor there as the 30 day period is effectively on pause until a remedy has been agreed upon and settled to your satisfaction.ping66 said:I received a new vehicle on 25th October last year and a fault developed within the first few days and I informed them I was rejecting the vehicle. .Although the supplier accepts that I have rejected the vehicle and finally, after much messing around will be collecting the vehicle and will refund my deposit and 1 months finance agreement they wish to charge for the use of the vehicle. Thanks for the feedback, I understood the 30 day clause to be "full refund". The 6 months is a reasonable deduction. I think I will contact the motor industry ombudsman and get their view of the world. Unfirtunately it isn't a trivial amount at just over £1000.0

You informed them that you were rejecting the vehicle sometime around the end of October last year and at the end of Feb this year you say that they will collecting it.
What has been happening to the car in the 4 months since you rejected it?

That last question is key. OP - have you driven it in that time?George_Michael said:

Yes I have driven it. The company I got it from were doing whatever they do with Mercedes and frankly I wouldn't touch Mercedes again. Mercedes were just a complete joke. I rejected it inside the 30 days after Mercedes tried to fix it and made it worse then told me it was 6 weeks lead tome for a part. Its driveable as its the whole ancilliary features that simply never worked due to the head unit failing. Just no aircon, satnav, radio, dynamic driving, etc etc etc. The good news is they are taking it back and as I said I don't want to be too awkward as I am sure this whole thing could be more painful than it has been.0

To reject it, you need to return it and stop driving it. You can't reject it and just keep driving it. So you're a long way from the dealer's? Unfortunately that's not the dealer's problem, but yours.0

Thanks for your input Mercdriver would be good if you read previous. It has been rejected, company has accepted it and finally got their act together. There is always at least one unhelpful person in a thread.0
