CCJ - Set Aside Today - What Next?

I had a CCJ for an unknown debt, at an old address, where a default had never been issued etc.... Reston Solicitors were awarded the CCJ in default (as I didn't know about it).

Today I successfully applied to the court and had the judgement set aside. It shows on my Equifax but not Experian credit report.

What is the process to have the CCJ removed from my credit file? Thanks in advance.

Nothing, it'll be removed in due course.
  • Excellent - is there a usual timescale for the CCJ to be removed as an estimate to work towards? Thanks

How are you checking Equifax? If you are doing it through Clearscore then they only update once a month, you need to check  it live, go onto Equifax website and do a free check there. If you have done this I would expect it to be updated overnight. If still showing after 24hrs contact them direct.
  • I have both only got set aside yesterday would it really come off that quick - with equifax be amazing if so!

just checked still on but case was only yesterday.

Get your defence in order, your suit re-cleaned and pressed, and anything else the judge may have directed at your hearing today in preparation for your full case hearing at a future date which hopefully you were advised of.

By that time, if you win, the CCJ should have been removed. If you lose, it'll remain and extended effective the date of the new finding.

I would expect it to be off the live reports within 24hrs. Under GDPR the CRAs have a duty to accurately report data, obviously showing a CCJ when it has been set aside is not accurate.

Just be aware that a set aside only takes things back to the pre-action stage, the creditor, can, and most likely will, re-send the papers to your current address, so don`t be too hasty.

You could send a copy of the set aside order to Equifax but it will as others say, be removed anyway - probably within 30 days.
