I have read a couple of reports recenly where PE have lost on signage.You never know how far you can go until you go too far.1 -
I agree and with UKCPM it's often a good idea to admit to driving, when the issue is with the signage.SlashDot said:I forgot to mention. So Gladstones have come back with their N180 - I've not had one from the court as of yet, but I've downloaded a copy to complete and send back to GS and the court. Gladstones are suggesting mediation as per usual, which I'll be disagreeing with as per the sticky thread.
Regarding witnesses - my partner was with me in the car at the time of the alleged offence so I could call him as a witness, but he would only be confirming everything that I saw. Is there any benefit to having him as a witness?

Hi @Coupon-mad, @1505grandad and other forumites. I hope you're all keeping well.
I've had my Notice of Allocation to the Small Claims Track (Hearing) letter through and have a court date at the beginning of October, so need to get my info pack sent off to the Court by next week at the latest.
Attached is my Witness Statement - hoping you have some time to give it a check over and provide any feedback? I'm going to put together my statement of costs and evidence over the weekend.

I've only had time for a very quick look but it is a good start but misses some important things such as the Semark-Jullien case. This is covered in the WS I wrote for @blancswann the other week, and that was also one where the Defendant wasn't driving. If you WERE driving, then look at the one I wrote yesterday for @painbl (either will do as long as you don;t copy any falsehoods or irrelevant stuff for your case).PRIVATE 'PCN'? Have you got the exact wording of the CPM sign. Some of them are badly worded and incapable of being performed anyway.
In answer to the earlier question, I'd definitely serve the second statement from the passenger. Ideally using their wording so it doesn't appear wholly identikit. If the passenger cannot attend court I'm not sure the defendant could be criticised, in view of the fact that keyser soze himself, Mr Chapman, has yet to give evidence in person in any court AFAIK.4 -
I do indeed @Johnersh - attached. I'm not sure if the wording is enforceable, but it looks identikit as it refers to possible AMPR use in the small print (with no such system in place) and it doesn't mention anything specific about the site (hopefully that means it's ok for me to post this here).Johnersh said:Have you got the exact wording of the CPM sign.
