PARKING FINE despite valid ticket GXS services Ltd

    Read the NEWBIES thread second post about LBC stage.  All is explained there.

    Get evidence.  Did you keep that pay & display ticket?  Why was it in the rear window not on the dash?

    Dear Fruitcake,

    Thank you very much; this is very helpful. 

    I obtained the SAR from GXS directly having complained to the ICO that they did not respond to my original request. I don’t believe that I have received all of the information GXS have regarding me because the correspondence with the Independent Appeals Service & with Gladstones Solicitors is missing from the information they sent me.

    They have sent me their photographs of my car. The front windscreen is shown clearly, but the rear is pixelated, and that is where the ticket was placed.

    I have photographs of my car, the location and the signage. It has now been altered, and they have sent me a picture of the new signage. 

    I do not know who owns the parking area. 

    I can provide witness statements from people who saw me buying the ticket. I also have the ticket.

    What is the exact name of the parking firm shown on each of the following:

    1. Original PCN/NtK 
    2. Paperwork from your previous correspondence (Gladstones et al)
    3. Paperwork from BWL 
    4. County Court claim form. 
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    They have sent me their photographs of my car. The front windscreen is shown clearly, but the rear is pixelated, and that is where the ticket was placed.
    Wow.  Lowest of the low!

    Reply to their DPO, asking for a non-pixelated version of the rear window photograph and remind them of their statutory duty to provide this, under GDPR and section 5.2 of the PAP for debt claims.

    Send the same request for that unpixelated evidence to BW Legal.  And tell BW Legal this (below - by email of course, no phoning them!) and ask them to explain why their client is providing altered evidence:

    The name of the company is GXS Services Limited on documents 1-3. I do not have 4; only a letter of claim.
