PARKING FINE despite valid ticket GXS services Ltd


I need your help and advice, please.
I parked ih the Bedford Row parking in Worthing , operated by GXS servises.
I purchased a ticket for an hour and displayed it at the rear window.On my return I found a penalty note , while the ticket was still valid.
The note said that I failed to display a ticket’
I filled an appeal to the company but it was rejected.
it was impossible to log on to IAS, because they can not recognise the penalty .The advice given From IAS site was to go back in touch to GXS Services Ltd.
This has proved to be impossible to get in touch with them.
I tried to complain to GXS but the mail they provided for that was not valid and my mails bounced back.
I left messages ,emails etc.,rang many times to
the phone provided .
I was deprived of appeal to IAS.
I had a final reminder For 100£ penalty threatening me with debt collectors .
I filed a complaint to IAS.
The link between IPS/IAS/Gladstone connection is well described so I don’t expect much.
What would you advice me to do next?

If you can find the name of the landowner, complain to them. Also complain to your MP about this unregulated fiasco.Other than above, all you can do is wait to see if the PPC issues court proceedings, come back if they do - they have 6 years in which to do so.At time of writing I'm not even sure I've seen any previous general forum activity about them, let alone a court case.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

|It is neither a fine nor is it a penalty It is an invoice from an ex clamper. You do not owe them anything unless a judge says you do.
Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

I’m surprised that this kind of activity is legal.
Looking at Company House they deal with security , gyms etc. The parking was very dark in December so I thought they didn’t see the ticket and all will finish when I send the ticket electronically .

I am a florist in worthing, based in the same building as GSX. I have been given 2 parking fine by GXS in worthing. I have been parking on a private space in Bedford row, rented by Pitch restaurant and with their permission park there for the time I need to refresh the weekly flowers for the restaurant. I display in my windscreen a note to say I am working at Pitch and have spoken to Mike at GXS who previously lifted a fine (the first one) when I explained to them the arrangement I had with Pitch Restaurant (their client). In December last year, they decided to ignore any conversations and requests from the owners of Pitch and with myself, and proceeded to fine me.
Also need to say that my flower shop in in the same building as GXS and I see Mr M O'Hara daily and have spoken to him about the parking notices. He is not a very nice man, he knows me, knows what I do but still proceeded to instruct his debt recovery company send me more correspondence.
As the correspondence now states it is too late to appeal the original parking ticket, what can I do?2 -

I had the same problem with GXS, I tried to appeal but the system does not recognize the ticket. GXS submits the tickets to IAS when is too late for appeal.

I would be very grateful for your advice for the case described above.
i received a ‘ Letter of claim “ from BW legal.
They ask for £160 or court action leading to £274 to pay.
Previously ,Trace debt and Gladstone dropped the case after I explained that I paid and displayed a valid ticket at the back of the car. This was to facilitate inspection , the parking was a herringbone type.
I involved myself MP and also wrote to ICO,
who found some inconsistency with GXS .
i wrote to the BW Legal complaint department but had no reply.
I don’t think BW legal suggested a ADR.
What would advise me to do?

Complain to the landowner (again if you have already done this).
Complain to your MP again.
Send an instruction to the solicitors that whilst you deny the debt, you are seeking debt advice and require the case to be put on hold for 30 days in accordance with pre-action protocol.
Send an SAR as per the NEWBIES to the DPO of the PPC requesting all personal data including all photos of your vehicle to be sent to you. You will need to include proof of non-photo ID with your request such as a copy of the vehicle V5C, a copy of the LBC, or two redacted utility bills or bank/card statements.
Start reading the guide to court written by bargepole that you will find in the second post of the NEWBIES.
Get your own pics of the site and signage. Use Google Streetview to see if there is anything useful there, especially if you need historic images.
