Today I received a "Letter Before Claim" from the Excel Parking. Another warning about taking me to court and issuing me with a new deadline to pay the debt by. I have until 12/04/20. Do I ignore this letter too? There is a form to fill out and send back to them.
The MP had emailed me yesterday stating he has sent a letter to Excel and if they contact me to let him know.0 -

Does it give you thirty days to respond or pay? If so, looks like a proper LoC/LBC/LBA/LBCCC and you should react as per the advice in NEWBIE second post about submitting SAR to the DPO of the PPC (unless you have already done so). Seems as if you will be receiving a court claim form soon, so maybe time to start compiling your defence. If they are claiming spurious amounts over and above the £100 (but not court filing fees etc) you can use the recent (last couple of weeks) template devised by Coupon-mad. Just search new template defence. If not, then NEWBIE second post and use of the 17 pre-written defence templates there to adapt and use.

Assume they have added their usual fake £60 ????? The MP must realise that the fakery of Excel is well documented on here These are factual and the MP should be raising this matter in the House of Commons especially the delay in the new code of practice which is overdueTheQAGuy said:Update

Ask your MP to request from EXCEL on what legal authority do they have to add fake amounts. They have NO legal authority but they may attempt to rely on the IPC code of practice which is utter rubbish

Yes, "pay the outstanding balance of £160 (the principle debt) within 30 days from the date of this letter". OF COURSE ... EXCEL are scamming you for a fake £60 and this is one main reason why the courts keep spanking them. EXCEL are abusing you and the courts.TheQAGuy said:

When you respond to their letter, ask them "what legal authority" do they have to add £60
THEY DO NOT HAVE ANY LEGAL AUTHORITY .... hence the scam.
They either tell you on what authority they have, and that will be shown to a judge.
If they fail to tell you then you duly advise the judge.

Yes, send a Subject Access Request to the parking company.
Whilst there is no need to delve into writing a Defence at this time, it can only be beneficial to get ahead of the game and prepare yourself.1 -
As advised by others, YES. Also it does not hurt to get ahead of the game by starting to compile your defence now - especially as Coupon-mad has done nearly all the work for your in her latest template for defence.TheQAGuy said:

I've sent my SAR (by email) to the DPO at Excel Parking. I have a question about this paragraph in the NEWBIES thread:
"As well as the SAR to the parking firm's Data Protection Officer (DPO), also write a letter - by email to Gladstones or BW Legal or directly to whoever the PPC is, if they are not using a solicitor. Your letter can state that you have sent their client a SAR and so you require a restriction of data processing and the case should be put 'on hold'. Confirm your correct 'address for service' (especially if you've moved and they've traced you & might revert back to an old address).
This is an EASY formal letter to write - it will not stop most claims but it looks better to respond. Gladstones & BW Legal will refuse. Please don't post about that...all as expected."
The LBC I received was directly from the parking firm. There is no mention of solicitors... So who do I send an email too, requesting the case should be put on hold? Or is the SAR sufficient enough?0 -
Excel mainly do the claims themselves. They have used the dodgy legals who failed them anyway
Excel don't do very well by themselves and infact no company who adds fakes to their claim will do well.
Understand that with the constant spankings by the courts for ABUSE OF PROCESS, if this follows through to court and Excel add fakes amounts, it will fall into question why they signed a statement of truth when infact it will be a lie0
