Excel Parking - Demand for Payment

Comments

  • Excel has updated my address and I did not provide them with any form of identification (which they were seeking):
"We can confirm that our records have been updated with your new address.
    Kind regards
    The Data Protection Team"
I cannot find anywhere who the landowner is of the car park, I've phoned the council and they don't know either (I did read somewhere that they do know, but are not allowed to disclose the information). I have managed to book an appointment with my local MP to discuss the matter. So, I'll update once that has happened.

In the meantime, the deadline to pay the "fine" is today. I'm bracing myself for another letter...

I am glad you are not paying this.  The case will be fairly straightforward to defend now they have your correct address and the claim will come to you in time.

Typos in VRMs are usually caused by the machine, not the driver and Excel have lost cases in court over this exact scenario:

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Sooo.... The "Final Demand" came through the post yesterday. Threatened me with the county court if I do not pay and they are going heavy on the CCJ and how that will affect my employment. Quite scary stuff to read.

They have given me a new deadline for the 5th to pay up. I have a meeting with my local MP that day, it'll be interesting to see what he says.

Question him about when the new COP following the passing of Sir Greg Knight's bill is likely to emerge.
You never know how far you can go until you go too far.

MPs are generally useless about this matter, so assume he will be clueless.

As ex clampers, EXCEL are still bully boys and threatening utter cr*p about CCJ's is part of their stupidity.
Only a judge can give you a CCJ, not a stupid jumped up parking company.. And that happens only if you lost and did not pay within the time period given, 14-28 days.
But this is EXCEL and with their sister company VCS are having major problems in court as they are being spanked because their claims are so poor.

So, don't be scared, head up and get your costs schedule ready when you win

Show this your MP and ask him to bring this matter up in the house. Bully boys cannot be part of our society .... Is that what Boris wants ????

I've just got back from my meeting with the MP (it was actually his assistant as he was stuck in London). She turned out to be very helpful. Said a number of people have complained to them about parking tickets. Interestingly, she didn't think Excel was allowed to be sending out these threats because their sister company VCS are in the middle of a legal dispute with the County Court in Caernarfon  (which is my local County Court). So, she'll do some research into that and also get the MP to write Excel a letter informing them to drop my penalty charge.

The deadline for the "Final Demand" expires today. They'll either drop the charge after the MP writes to them, or they'll take me to court. Who knows.

They'll take you to court and I think she's out of date re Caernarfon.  It doesn't stop Excel filing a claim.

What are my next steps? Wait for the court papers and then begin my defense? Or do I now complain to POPLA?

Yes.  Get pics of the site and signage. Identify the landowner. A copy of the Land Registry entry will cost you a few quid.
Complain to them. Get your MP to complain to them.

Wait for real court papers giving you 30 days to respond. If they include financial forms, do not fill them out.
Read the guide to court by bargepole in the second post of the NEWBIIES.

PoPLA have not and cannot be involved since Excel are not BPA members.

Keep on with your complaint to your MP who you may need to educate a bit first and explain the damage this is doing to the local community.
