LBC UKCPM/Gladstone's

Hello,

I've been parking down a "private" street, I didn't realise at the time but there is an ANPR camera when you turn onto the street which clocks you going in, then you have 30minutes to leave before it then registers you as overstaying and you get a "fine" sent out. I have about 9 outstanding PCNs, I have two of them that have now gone to LBC.

    And this is the big joke ...... this is a pre-determined amount ?????? ....  pre-determined by who ?
    Where this rubbish comes from is the IPC scam code of practice and Gladstones set up the scam IPC
    This is their own pre-determined dream with no authority or legality to it, especially as the code of practice cannot be legally binding on the motorist

    You need to reply to a LBC, you are now armed with the information to query their legal authority, use it

    Because that letter threatens court for only TWO of nine PCNs, what you MUST do now is reply and say:

    (a) you are taking debt advice so Gladstones must put the case 'on hold' for 30 days, but
    (b) any debt is denied in any case, due to the woeful signs;
    (c) a driver has no chance to agree to any terms and this is a 'concealed pitfall or trap' (Beavis case phrase identifying penal charges that would fail).  What appears to be public highway is being operated by a predatory ticketing camera system, as if it were a commercial private car park;
    (d) UKCPM have harassed the keeper with no less than NINE PCNs - not two - and relying upon settled law in Henderson v Henderson for authority, you remind Gladstones that their clients have a duty to bring their entire case, not just part of it, if they commence proceedings.  Thus, you require full disclosure under the pre-action protocol of ALL PCNs, all photos, all letters, every piece of evidence and data held by their clients including a copy of the 'terms' on a sign (photographic evidence, not a sign replica image). 
    (e) Then, a fresh, properly consolidated Letter before Claim must be served instead and you will allow them to contact you within the 'on hold' period, but only to supply the required PAP and data information.  However when serving the evidence and data bundle plus a new consolidated LBC they must then start a new 'PAP reply' 30 day period and if they fail in any step, you will raise it with the Judge.


    List the nine PCN numbers (carefully double checking them) in the title within your email, or at the end where you put your name.  Append a copy of your V5C as proof that you are the registered keeper data subject entitld to the information.

    Don't miss out any of the above a - e in your response.  They are all suggested for a reason, to help you later.

    Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

    Regarding writing back to Gladstone's, I just double checked and it's 16 PCN's! So this is the only letter I have had from Gladstone's, the 2No. PCN's that are in the letter I posted above. The other 14, I have only had letters from TRACE Debt Recovery, at this point Gladstone's have only been passed on the 2 PCNs as far as I'm aware, is what you've said still applicable that they have to bring me the whole case and not part of it?

    I do understand that it is UKPCM that are the company taking me to court, but if it started off with TRACE chasing me for 16 PCN's, then passing to Gladstone's, will Gladstone's have all the information to send me for the 16 PCNs?
