I want to take cowboy parking firm to court!!

    You never know how far you can go until you go too far.
  • Do UKPC claim they can hold the keeper liable? If so, and they know they cant - as it is too late - then this  is a complaint to the BPA AND to the DVLA.
    I've complained to BPA but will lodge DVLA complaint now....
    Have just had this response back from SAR;

    Good Afternoon,

     Thank you for your email requesting for the disclosure of the information that UK Parking Control Limited holds on you.

     The email address which has been used to make this request does not match up with the driver details we hold. Therefore, we will require consent from the driver giving you authority to act on their behalf.

     Because we have received this request by email we must take steps to verify the identity of the driver. Please provide us with proof of address, photo identification. Once we have verified the identity of the driver, we will process the request and will consider the information provided to determine whether we can comply with the request.

     We will comply with the request within one month from the date the drivers identity is verified. If we consider the request to be completed, we can extend the time for responding to the request by a further 2 months. If an extension is needed, we will let you know within one month from the date the drivers identity is verified.  

     Please note that because we have asked the driver to verify their identity, we are required to inform you of the following:

     a) The reasons why we have requested additional information from you (please see above);

    b) Your right to make a complaint to the Information Commissioner’s Office; and

    c) Your ability to seek to enforce your right of erasure through a judicial remedy

    You do not need to tell them the driver's identity.  You are requesting, as per GDPR regulations, any data they hold about you the KEEPER of a vehicle with a VRM of XXNNXXX.  Driver of that vehicle is irrelevant; there could be many drivers.  If they do not comply within 30 days of your original application and you supplied a copy of your V5C or a scan of the PCN, then a complaint to the ICO is in order.

    WHAT UTTER RUBBISH ....... go ahead now and complain to the BPA and the DVLA
  • Pointless response from BPA;

    Please be advised UKPC does not have to follow the Protection of Freedoms Act 2012 (POFA 2012).  It is POFA 2012 that dictates that the Operator must issue a charge (via ANPR) within 14 days of the alleged contravention.  If UKPC have not mentioned this legislation on their documents, they are not intending to rely on it and therefore the timeframes do not apply.

    How do they know the identity of the driver, did you tell them?  If not may be in breach of the law,  consider a complaint to the ICO..

    That needs a complaint to Steve Clark at the BPA.

    UKPC are twisting a SAR into demanding to know who the DRIVER was.   They cannot do that!  Email Steve Clark:

    IMO this behaviour is deserving of sanction.  Do not hold back in your retribution.

    I haven’t told them, I am assuming as it’s a leased vehicle they have contacted the lease company and been provided with a name which they are now choosing to withhold information as it is not the name that matches the email address!! I’ll post their latest reply......
  • As the vehicle was hired, the registered keeper has passed onto us the details of the hirer.  There was a breach of the terms and conditions of parking which were clearly displayed on the signage at the car park and were agreed by the driver when entering and remaining in the car park. The driver is therefore liable to pay the outstanding parking charge.

     

    Because the email address we received the subject access request from does not match up with the details we hold, we have therefore requested that the driver’s identity be confirmed. We would also require consent from the driver which gives you authority to act on their behalf.
