Accounts still listed after DRO

I was issued a DRO in April 2014. It was closed 12 months later and I understood all accounts would be closed and that would be the end of the matter. I recently signed up to credit karma and I’m dismayed to find that two debts are still listed on there and have been listed as defaulting on payments since 2014. One of them is PayDay UK, and it doesn’t match any information listed in my DRO, even though I am 100% certain it was included, there will have been no logical reason for me to excluded anything. The other is JD Williams. I’m pretty annoyed that I now have two debts showing almost 6 years of default payments. What can I do about this?

What you should have done at the end of your 12 month deferment period, perform a credit file clean up.

Not all creditors are aware of how to mark your file in a DRO, all accounts should show as settled, or satisfied, with a zero balance.

Any that do not, send a written complaint asking them to correct the error, if they don’t or won’t, escalate to the ICO.

  • I had this issue after my DRO.

Just send a letter to the data controller of the company in question. Template below from another site. They should sort it out.

    2) Creditor doesn’t mark debt as satisfied when your DRO has finished

The creditor doesn’t have to mark the debt as fully settled/satisfied so there is no point in complaining if the debt has been marked as partially settled/satisfied.

If the debt isn’t showing as closed with a zero balance four months after your DRO has finished, send the following letter to the data controller for the creditor:

    re: [account/reference xxxxxxxxxxxxxxx]

My Debt Relief Order finished on dd/mm/yyyy. I attach a copy of my Insolvency Service Register entry which shows this.

I am writing to ask you to correct my credit file for the above debt.  The ICO guidelines state that my credit file should show that I no longer owe money on that account, perhaps by marking the entry as ‘partially satisfied’ or ‘partially settled’ or in some other way.

Please correct this entry within 28 days or supply me with a written reason why you will not do so.

  • They’re showing as 5 years worth of defaulted payments, can I ask them to remove this too?
