Received a PCN from Excel Parking Services Ltd due to a faulty machine

  • No, you didnt HAVE to do that. At all. You fell for their fishing. 
    To forum regs - outed driver here, so NO comments about POFA. 
    That much is obvious now, I didn't think it would be this hard to shake off as it's completely unjustifiable. I'm just wondering if me doing that has essentially ruined any chance of the pcn being overturned

    Excel are members of BPA, did they send you a POPLA code along with your rejection?  If they did, you need to write a POPLA appeal (help in NEWBIE sticky 3rd post), if they didn't then complain to BPA.

    Sorry Le_Kirk, but Excel Parking Services Ltd are members of the IPC's Accredited Operator Scheme, not the BPA AOS.

    I have been advised to request a SAR on a parking charge group on Facebook. I have been given the following template to use:


    Subject access request 

    Parking company XXXX 
    Dated XXXXX

    Your Name XXXXX
    My Address XXXX

     Re PCN Number XXXXXXXXXXXXX

    Please supply the information about me I am entitled to under the Data Protection Act 2018 relating to: 

    • Any and all Documents mentioning my name or any details relating to myself i.e. vehicle registration/contact details/ PCN number etc 

    • A log of all vehicle registrations entered on you any of your machines on the 2/2/2020 between  17:00 and 23:59 at the site in which you claim the driver breached your terms. For the avoidance of doubt, this is The Quadrant Car Park, Redditch, B98 8AE

    It may be helpful for you to know that a request for information under the Data Protection Act 2018 should be responded to within 30 days. The 30 day compliance limit commences 2 days from the issue date noted above. 
    If you do not normally deal with these requests, please pass this letter to your Data Protection Officer. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you and can be contacted on 0303 123 1113 or at ico.org.uk

    Doh!  Having fallen foul of this issue before, I checked and, according to BPA, Excel Parking Services are members.  Maybe they are corporate members?  How to explain the attached pdf?

    There are two lists on the BPA website - BPA Members and BPA Approved Operators.

    Listed respectively:

    Note the comment in italics on the front page of that first list:
    Please note that this is not a list of members of the Approved Operator Scheme (AOS). To confirm Accredited Trade Association membership of an operator please check the list of AOS Members
