Received a PCN from Excel Parking Services Ltd due to a faulty machine


In their response to my appeal they say I can either pay the reduced fee or appeal to the independent appeal services (IAS) but as soon as I appeal the fee will go back up to £100 should I be unsuccessful again. Is there any way out of this? The only proof I have is a photo of the machine just after it didn't dispense my ticket but obviously this isn't exactly overwhelming evidence in my favour as the transaction was processed before the photo.

If there is a faulty machine you cannot complete your part of the contract. If there is no contract surely you cannot breach it. If they are daft enough to take this to court they are likely to crash and burn imo. Read this

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

I have already appealed this PCN formally with Excel Parking ltd. They sent me a reply saying they are unable to consider my appeal as it's unclear if I am liable for the fine. So after accepting liability and giving them my details they have rejected my appeal anyway stating I should have checked signage for a help line number if the machine was faulty. Also after just checking, my time of contravention was 18:55. Which is just 5 minutes before parking was free.
So I feel like I've almost been snared into taking responsibility for this PCN when they were going to reject my appeal anyway. I also took a photo of the machine just after it didn't dispense a ticket, this doesn't exactly prove anything to them though other than I was at the machine at the time in question.0 -
