  • Hi Weston you are now making an assumption that I booked a non refundable ticket. You are correct in the fact that OTB booked a non refundable ticket. This was at never pointed out at the time of booking not during and Emirates have said if OTB had booked a refundable seat we would have not had an issue. May I have your thoughts on this
  • Hi JGB I suspect you may be right. Although this isn’t a change of heart this is due to a medical situation and something we never signed up for. So feel pretty disappointed

    It appears that Westin made the correct assumption.
    I think most of us thought the same.

    Take it up with OntheBeach.
    Ask them why they didn't tell you they were booking non-refundable tickets.
    Ask to hear the recording of your telephone call.
    That's a problem with using 3rd parties to book flight tickets.
    I book my flights direct with the airline.
    It's very clear what level of ticket you are buying - whether they are refundable, whether they are flexible.

    I think any blame here lies partly with you for not doing any research about the airline you were flying with before booking and partly with OTB for selling you the cheapest ticket they could buy on your behalf. 
    All Emirates have done is have a policy that you don't agree with (I appreciate why you don't agree).
    That policy existed before you made the booking with OTB and was clearly stated.

    I never book flights through third party, too much can go wrong but even if Emirates did agree to not serve nuts, which they will not do as none of their meals are nut free, what about people in your close seating area, are you going to ask them to not eat anything that has not been prepared in a nut free environment?  I have been on short haul flights when an announcement has been made that no nuts will be served and that is fine by me, but I do think it's just a customer relations thing, you can't stop someone eating their own food items.

    Yes, how can you guarantee other passengers won't have nuts?
    We used to fly TC long haul to Goa regularly some years ago - it was a route used a lot by People of Indian origin (PIO) to get back home to see their families as well as holidaymakers.
    A nut allergy announcement was made before take off but I happened to be sat amongst a group of very exuberant (but extremely pleasant, interesting and entertaining) males all going to see family.
    They were passing round snacks obviously prepared at home, some of which clearly contained nuts and they had bags of cashew nuts and Bombay Mix. I'm talking probably 15 people over 4 or so rows.
    I doubt they even heard the announcement.

    The last time we flew with TUI, I had several small packs of 'gin nuts' (Roasted peanuts and nuts with pistachio kernels in a thyme & lemon flavour.) to drink with a G&T on the flight.
    Before we opened them, I asked cabin crew if there was anyone on board with a nut allergy - I hadn't heard any announcement.
    She confirmed 'no' and was very pleased that I'd actually asked.
    But even on flights that do make an announcement, you can't guarantee that there won't be someone who does open a packet of peanuts.
    I think the fact that the OP's son has flown without problem is more down to luck.
    At least Emirates are upfront about the risk unlike those airlines you mention (Ryanair and Thomson - who have actually been TUI for over 2 years) who can make all the announcements you like but they cannot guarantee that someone won't have a nut-related product.

    Emirates are quite right to refer the OP to OntheBeach.
    His contract is with them rather than Emirates.
    It's OTB who have the contract with Emirates.
    That's how using a 3rd party works.
  • The issue here, as I see it, revolves around not advising OTB of a serious health issue when making the booking.
    Lack of due diligence on the OP's part, unless OTB were informed and chose to ignore that information ?
    That would need to be established before anything else to move this dispute forward.
    I don't see how Emirates can be criticised in any way, upfront they've made their policy clear in the public domain.
    The OP appears to suggest the airline "plays fair" and stop any nut related products or food being served on two flights ?
    How is that fair to the other passengers ?

    OTB and similar agents offer the cheapest possible price, which is what people are usually looking for. To have any kind of.flexibility or refundabilty  youw need to pay more, and the conditions of carriage that you paid for would have been available to view, and necessary to confirm your agreement to them, when you actually booked and paid. I'm afraid it's not reasonable to expect to be reminded of the terms of your purchase again, before payment, by the online agent.
