Can this be right?

2 weeks ago i bought a surprise birthday present for my daughter, it was a £420 printer, so as a suprise this week i opened it up for her only to realise it was the wrong printer, the printer has been unboxed but has never been used, the company are refusing a refund.
The printer was bought in-store on a barclaycard,  these are their TAC on their website
Your Mistake / Changed Your Mind
If you wish to return products that have no fault with them then we reserve the right to charge a restocking fee of 20% subject to compliance with EU distance selling regulations for consumer purchases. The restocking fee is is due to the administration costs and credit / debit card surcharges that are incurred in processing the order. You are responsible for returning the items to us in perfect condition at your expense. Please ensure you pack the items properly as if any item is damaged it will not be accepted for return. Carriage charges cannot be refunded once the order has been despatched from MDP Supplies.

    You bought instore, so you have no right to a refund due to change of mind (which this would be). The website terms are not applicable to an instore transaction.

    That unfortunately is your fault. Theres nothing to cover in store mistaken purchases and anyone who offers more than that does so in excess of your rights.
  • Why havent you asked them to exchange for the right printer? They can still refuse this, but theyre more likely to agree than to lose a sale entirely by refunding you.

    MDP Supplies appears to be a wholesale only company so you wouldn't have consumer rights on a B2B purchase.
  • Why havent you asked them to exchange for the right printer? They can still refuse this, but theyre more likely to agree than to lose a sale entirely by refunding you.
    This is a valid point.  No harm in asking, but as Fosterdog points out, it appears they're not a retailer but are a wholesaler.  That's why there's a re-stocking fee.

    As for it being a shame they're allowed to do this, why did you choose to buy from a wholesaler rather than the many, many retail outlets from which you can buy a printer?

    They say they will sell to individuals as well as businesses so they are also selling to consumers and can't impose only business contracts on consumers. This make their restocking and CC fees illegal for the consumers that purchase from them.
