Totally confused, now terrified.

Hi, I'm after some help. I claim ESA and PIP. Now when i got married in 2016 we went to the local job centre and explained the situation, my husband does not live with me full time. He comes home two/four days a week, then goes back to his mums to care/help her.
I explained this to the job centre ''adviser'' who looked at me with disgust when i said we were married LGBT couple.
We also explained our situation. The adviser told me that i cant claim for him, as he doesn't live with me full time.
My husband does not work, nor does he claim any benefits. When i asked about carers allowance (claimed for me) we were told 'no' as he doesn't live with me full time.  I asked about my claim, would it change. The adviser said it shouldn't and he typed some stuff and that was it, i heard nothing else, until i tried to claim carers allowance again (Please note that this is for me only, he doesn't claim carers allowance for his mum) again we were told no, as he doesn't live with me full time.
He tried to claim carers allowance back in Wales whilst he was with his mum and again he was told no as he doesn't live there full time.
My claim has carried on as normal, now i find out that nearly four years later the adviser never changed my claim. I've been claiming as a single man who lives alone. Last fortnight my money didn't go into the bank as normal, and i phoned and they did a direct payment. Now i have received an LPT1 form, which wants to know my house/bedrooms and who lives with me.
Im terrified now, because i don't know what to do. My husband is my carer and he is also his mothers carer (we live 140 miles apart)  But we don't live together full time. he spends maybe three/four days a week with me. Helps me out.
Now my husband has developed Fibromyalgia, so he sent off for a pip application form from my address.  Since then i have had this form come through.
His Pip form never arrived, and now they are looking into my claim.
I really don't know what to do. I have read official terms they use to evaluate a claim but its all Greek to me.
I receive ESA and PIP and i have spinal damage (i cant walk maybe fifteen meters and i cant stand for more than two minutes or so, also the meds i am on cause me to say words in the wrong order, and my memory becomes foggy if i try and ''go back'' to remember what i had for breakfast.
I have read on other forums that receiving the LPT1 form means my benefit has been suspended. (I only found the form this morning soaking wet in the bottom of my mailbox the postman left the lid open) no letter accompanied the form. I have to note everything down on a calendar to remind me to do stuff.
Im sorry for rambling on, but now i'm terrified i'm going to be made homeless, and be done for benefit fraud.
I must point out that i pay for everything, my husband does not contribute to anything in my home (well we share a netflix account) but that's it.
He gets money from me, for things he needs, and or his mum.
So what can i do?

Doesn't matter who pays for what you are a married couple!

How on earth can he possibly be caring two people 140 miles apart! And when he is disabled himself! It was going to be questioned at some point. Having a pip form requested has probably prompted them to enquire who lives at the address.

Before we were married he lived full time with his mum (we were in a long distance relationship) after we were married no more than two weeks, his mothers health deteriorated. So he started to spend a few days a week with her, sorting her online deliveries, prescriptions, hospital visits, you know the usual. Then it just kind of stayed like that. All medical emergencies for his mum are dealt with a careline that contacts him (if hes with me)
Its two and a half hours for him to travel, and yes, he does do it. We only realised something was wrong when he started having tremors, and complaining that a simple touch caused him pain, along with migraines, and pain along the jaw. It took months for him to be seen, and they think its fibro, and hes got to have scans. I have tried to move to Wales to be closer and everything, but unless your from wales, you aren't getting on the housing list because im adequately housed. She lives in a one bed flat, and i live in a zero/half bedroom bungalow, direct exchanges wont work either, So yes its possible to do what he does, and ive got family closer to me if something happens whilst he isnt here.

You say he lives between your house and his mums but some weeks he spends 3-4 days at yours and then applies for PIP using your address. That will have caused issues to start with. Where is he registered as living? what address does he use for his bank? where is he registered for GP?
The only benefit that could potentially be a problem with will be single person council tax, which you maybe claiming. Your ESA is less for a single person than it would be for a couples claim, housing benefit will still be 1 bedroom.

His GP is registered here,  (wait times for hospitals are abysmal in Wales) and his bank account is registered here (he had problems with mum opening his mail)  The thing is he isn't registered as living anywhere. His Mum told her council about it and they put him down as no longer living there, when i mentioned it to a adviser, i was told that as he spends no longer than three/four days with me, then i don't need to register him here either. This is the problem we have when i tried to find out about him getting carers allowance for me.  Now i don't know what to do. My mental health isn't the most stable thing to begin with, and as i've said, if i don't put stuff down i usually forget about it in about an hour.  But now i'm spiralling. My mind is going around and around in circles, and i'm fighting a full blown anxiety attack. I know ironically that DWP is paying me less than couples rates. but after what i've heard about people being put on UC due to a change of circumstances terrifies me. People paralysed from the waist down, being told that they can walk, People on UC getting £4 for a month to live on, people being evicted because of it.
I have family here for an emergency, but in reality i have no support network apart from the hubby.
I really am at a loss of what to do for the better.

Claiming as a couple in these circumstances will not prompt a move to UC because he can be added to your ESA claim. As his GP is with you and his bank address is your address then you're pretty much saying he's living with you and not at his mum's. The only thing i can see an overpayment with will be council tax for the single person discount, unless you're claiming the severe disability premium in with your ESA, then you'll have an overpayment for this, from April 2019 this is £65.85 per week, slightly less in previous years.

Regardless of what you read with UC not everyone is worse off. If you're in the Support Group for ESA and you're not receiving the severe disability premium then you could be better of claiming UC because LCWRA (support group) pays more than ESA.

Thank you for your advice, I'm phoning CAB a little later. I have had a mostly sleepless night, literally running around and around in my own head.  I do get a disability premium, but i cant remember if its severe or not.  I just know my ESA is made up of two parts.  Thank you again.

If your ESA is £128.45 per week then this doesn't include the SDP. If it's £194.30 per week then this includes the SDP.
  • Then i get the SDP. thank you

The form that you received is not from DWP it is a property tax form  but claiming the SDP when your husbands address with his bank is with you and his GP is registered with you, is simply saying that he does live with you.
  • The form is marked LTF1 05/18
Apologises I didn’t realise I had typed it wrong.
Hyper anxiety isn’t really helping me right now
