What legal action can i take against management company?

hi
i currently own a property managed by a property management company who we pay service charge for the maintaining the building under a management agreement
there have been serious issues with the drainage around the property causing leakages into some flats (mine much more then others due to the positioning), i have raised this to the mansgement company numerous times but no actions have been taken or promises which then dont get fulfilled

i am looking to take legal action against them as have tried to resolve this for so long and got no where.  What rights do i have and what would they be in breach of eg negligence or breach of contract?  I know there is a property redress scheme or would i be better going through the courts for remediation and damages?

thanks

Who owns the freehold of the block (residents or other freeholder)? Have you raised the issues with them as they employ the Managing Agent

He would employ the Managing Agent. It might (underline might) be the quickest way of getting something done if he did intervene

It was the freeholder who chose and employs the Managing Agent?

The Managing Agents (MA) do the leg work for the freeholder/Residents Management Company. In your case, as xylophone says, your freeholder will have appointed the MA and can instruct them to do what they want (within reason and the law, of course)

I messaged the freeholder who advised he didnt appoint the agents so it must be the residents group?

Perhaps reply and ask him who did?

Do you have a residents group ?

Someone will be paying the MA.
