They could, with enough warning, cancel your holiday and simply rota it as a normal unpaid rest day so you worked all the other days - but then you would have another holiday to take later (and they could tell you when).

I work different hours and days every week
I don't know what I will be working until the following weeks rota is released
according to the government website I am allowed either one day off every week or two days within a fortnight
My first question is do I get to choose which of these I get?
second question is, several times when I have booked a day off as holiday the rota will come out and my employer will use the day I have booked off as the only day I have off, so I'm wondering if paid holiday counts as a work day and if so do the previous rules still apply
    Thanks for any help.
A day's holiday is a day off when you are not working.
Yes you're not physically at work but as you are being paid for it does it not still count as a work day with regards to you still being allowed the weekly rest entitlement?
Imagine if your employer made you use your holiday for your weekends
So you are looking at pay and not time.
If I take a week's holiday, I get paid my salary for that week.  Does that mean I haven't had a rest?

So if you take 1 day as paid holiday and work the other 6 days of the week, do you get 7 days pay for the week?
    ^^ This
It will depend on how many days in that particular week you have been paid for - a paid day wouldnt be considered as a rest day regardless if you attend work or not
Ok thanks, yes I would get paid for 7 days which is why I also thought I should still be entitled to a rest day
If you were paid for 7 days that particular week (6 working and 1 holiday day) then this is correct and your employer has done nothing wrong.
How many hours do you work each week?  Have you opted out of the 48 hour weekly limit?

Pretty sure the answer is no they can't count annual leave as part of your weekly rest.

OP you have it from the horses mouth now. /thread.

Sometimes my advice may not be great, but I'm not perfect and I do try my best. Please take this into account.
