Trees falling into garden who is responsible

In the bad winds a few days ago several of our neighbours fir trees fell into our garden.  They've done damage to the pond, the liner must have been pierced as it's gradually going down.  Who should get them taken away, we don't want to have to pay.  Hubby has remarked to the neighbour several times about the danger of the trees but nothing has been done.

    Meant to say that I presume a lot of the shrubs have been damaged too.
  • Their trees, so certainly their moral responsibility.

    In what way did hubby "remark to neighbour" and over what period of time. Did hubby say this verbally in passing conversation or in any sort of more "official" type way (eg writing neighbour a letter and keeping a copy of it)?

    Thanks for the reply, it was just a general remark not official at all.  He did start to cut them down but didn't judge it right and they fell into our garden then too, so I think that's why he gave up

    The trees have fallen on the thing that hubby made to protect the pond pump etc. not sure if there is any damage there.

    We were lucky that the trees aren't near the bungalow,
  • I guess first stage is take photos of the damage and ring the legal helpline that comes with your Insurance coverage for house/possessions. Do you have the legal insurance add-on to your insurance policy?

  • Do you have any close ups of the trees? 
    This will show their condition, whether they were healthy or showing signs of disease.


    Mortgage started 2020, aiming to clear 31/12/2029.

    Hi No we don't. Photos have been taken.

    We don't want to go through our insurance really.

    If they snapped off and were healthy trees, then it's an unfortunate accident due to the recent weather.
