    DQ stage is normal.    She has to do one as well and tick ''no''.

    Download a DQ N180 form for her to complete and tick ''no'' to Mediation.  As per the advice about how to fill in the DQ, in the NEWBIES thread.  It takes you through every question and we NEVER advise Mediation and she won't get an adverse inference due to not mediating because her position is, there is no debt to discuss.

    thanks will do that is I did read about it a bit this morning by bargepole ..is there a time limit on doing that? And Will the court send her a form as well?

    You would normally receive a DQ from the CCBC/court and that would come with a deadline, however there is nothing to be gained by delaying so just download and submit your own.

    I don't think the local court will post a DQ because this is a post-set aside case, so download one so she can level the playing fiels with the Judge, so both DQs arrive and hers clearly says she want a hearing in person at xxxx court and that she does not agree to Mediation.

    I thought it was a set-aside issue (but it is such a long thread now) and wondered why DQ was involved at all.

    Because the other side has sent one, the Defendant should do the same to avoid being pushed into yet another phone call.  The Judge needs to see that Mediation is NOT agreed by the D.

    The N180 can go to the court and the solicitors by email, nikkietoni.

    And as we regulars know, Mediation is horrific for someone who is not confident on the phone, it is bullying by another name and far worse than her set aside phone hearing when you are actually being pressed to offer money by someone who is clueless, but that's their job!

    Do you know when my daughter applies for me to be lay representative for my daughter in the case. Do I wrote to the courts or anywhere specifically ? Thankyou
    i am sending the DQ form off today via email so not sure if the request should go with that form
