Universal credits with temporary buy to let

My husband and I have recently separated, I am staying in the marital home with our 2 children. We have a buy to let (in my name) which my husband/ex will be moving into for 6 months until we can apply to have our mortgage transferred into my name. I will then sell the buy to let which he will be taking any profit (approx £40k-£50k equity) from to buy a new house. However in the 6 months whilst I still own the buy to let will I be entitled to Universal Credit? Is it worth applying to see or will they then register that there is a large amount of equity in my name even though I will be gifting it to my husband?

This needs to be sorted out properly through the divorce. You cannot just gift 50k to your husband and then claim benefits.0

I can't see that as described your situation triggers any of the capital disregards. I think the only way you can trigger a disregard is to put your second property onto the market now, in which case a six month disregard would apply - see H2115.Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.1
