    Hi
The SAR came through via Signed For post today.
It is quite obvious that the parking charge is due to my friend.  12 minutes stay without paying to be there.  The car park stipulates that payment should be paid within 10 minutes of arriving.  It is only a very small piece of land outside some shops.
We have re visited this site and there is plenty of signage.
My friend is quite willing to pay the full £182 just to close off this situation.  However, I think that my friend & I should at least get some more advice regarding the added costs of the "Reasonable Sum To Recover the Debt" which is £82,
CEL bank details are on the back of this recent letter.
The SAR recived back did not give any reference to the breakdown of the £82 "Reasonable Sum to Cover Charges that CEL have incurred.
    My question is;
    - Has anyone ever just paid the £100 and refused to pay the £82 (in earlier replies on my forum case, this sum has been described as "Unlawful Amounts"
    - If I got my friend do a bank transfer of £100, would the 'Reply' Form, (originally sent a few weeks ago with the Letter Before Action pack), need to be sent back, filling in the Box B which stipulates "I owe some of the debt, but not all of it".
We are certainly not prepared to go to court, so if the above reduced payment is not a wise option, then I will advice my friend to pay the full amount within the next 14 days.
    Thanks for any advice.

That would be daft (sorry but this is a moneysaving site and the Defendant will probably pay ZERO).  CEL will very probably discontinue before the hearing, as they usually do.

Don't let this friend be that person who gets our advice then pays the scam anyway and funds/sponsors the parking firm!  Absolutely not a good example to set to friends and family.

We are certainly not prepared to go to court,
Why on earth not?  It's actually interesting and exhilarating, just a meeting at your local court in a formal setting like a job interview - you'll see how county courts work.  No risk, no CCJ, no effect on anyone's credit rating; nothing bad.  Not even if the case was lost (and the £82 would be wiped off as long as the Judge 'gets it').

And anyway CEL usually discontinue, as I keep saying!

if the above reduced payment is not a wise option, then I will advice my friend to pay the full amount within the next 14 days.
Neither of your ideas are a wise option.   For starters, an alleged twelve minutes is in the range of a 'MINIMUM OF TEN MINUTES' grace period set by the BPA CoP.  It's closely within that range, far more than this £182 charge is within the Beavis case '£85 range'!

I have no idea what you were expecting but OF COURSE the SAR was going to show the car there for 12 mins.  Nothing has changed.  Almost no-one loses v CEL and no-one ever pays £182 unless they are clueless.  And you aren't!

Thank you very much for the further advice.
I have liaised with my friend, and you have given us the confidence to take this further.
At this stage, do we just now sit tight, not respond, and wait for further correspondence from CEL?
  • Hi anged,
Did you manage to get anywhere with this?

    Thanks

You do realise I hope that an MP recently suggested a lik between some of thes private parking companies and organised crime.  Woulf you want your friend to be funding people smuggling, white slavery, ot the importation of heroin?

    Hi all
Well It seems that CEL have decided to pursue this case again and have sent my friend the Claim form from CCBC.
    Claim was issued 25.03.22
    AOS submitted 31.3.22

Clicked through to next section on the CCBC account and there is the box 'Defence - Defence Particulars'.
I know that there is mention in one of the advice sections from here that the full Defence is to be emailed to CCBCAQ, however, do I still fill in something on the CCBC section (only 122 lines allowed).

    Thanks

Absolutely not so much as a full stop in the defence box!  DO NOT EVEN CLICK ON 'START DEFENCE'.
