Hi All, is there anything i need to do prior to the hearing this Friday (31/07) ? Ive been reading some threads which refer to the hearing and im feeling pretty comfortable about it. I will prepare a crib sheet as advised in the newbie thread to take with me on the day, along with a copy of my defence and WS (which includes evidence and cost schedule). Is there anything else i should do?
A Couple days after submitting my WS, i had a missed call from Gladstones but they didn't leave a voicemail. Why do you think they would try and call me at such a late stage? I was half expecting them to pull out/discontinue their claim considering the contract issue alone. Is there a deadline they need to discontinue by?
Thanks0 -
They will try to scare/coerce you into paying something by disguising it as a "special" or "Covid19" offer. Don't play their game. As far as being prepared for court is concerned, if the court and the claimant both have your defence, witness statement, evidence and summary costs assessment you seem to be set. Good luck!3

Someone at Gladstones wants to offer you a super duper deal not to go to court.
All tricks of the scam trade. Given everything you say, Gladstones will be due a spanking in court so wait, they can discontinue up to the day in court, but they must be reasonable and recently they discontinued with 3 days to spare. This is a game that Gladstones are terrible at playing2 -
good luck...Ralph1

Update. Arrived nice and early for the hearing and checked in with the usher. 30 mins later and the hearing began, claimants side were a no show! So was just me and the judge in the room; the judge went through the case, and said i had provided a detailed witness statement (which i think the judge liked). The judge started off on the main point of the contract being in different name to the claimant, and low and behold, dismissed the claim entirely. The judge went through my other points (Jack Chapman Witness Statement, Abuse of Process, Grace period), and was in agreement with all the points raised, and said even if the contract issue wasn't there, the other points would of had merit.
Onto costs, the judge was happy to award my full costs, of loss of earnings, petrol, and the time i had spent researching and preparing my defence and witness statement, at the litigant in person rate of £19 per hour. Total costs awarded - £560
All in all, a complete spanking for UKCPM and Gladstones.
ANOTHER ONE BITES THE DUST
Just want to say a huge thank you to everyone who helped me with this case, you are heroes, not just for the advice given to me, but to the advice given to all those who come to these forums looking to make a stand against the corrupt parking operators that are out there. Keep up the good work!9 -
Wow, that's brilliant and a great result with the costs also.4

Double wow , a proper spanking in court for those 2 sc@mmers
And Another one bites the dust !!
They won't like that result but they started it , you finished it with a right cross followed by an uppercut , so 2 black eyes for them
Again , well done
Name of judge ?
Which court ?4 -
Brilliant, about time UKCPM found a legal who did not take the pi*s out of them.
Second thoughts, maybe not, we enjoy such incompetence4 -
Brilliant !
unreasinable behaviour costs are great. I imagine failing to show annoyed the court a tad.4 -
Hey, hey, hey, super result. Congratulations on taking this right up to the Judge's desk. Fabulous result and a hole in the pocket for UKCPM. No doubt after paying you your costs, they'll get an invoice from Gladstones for services (un)rendered! 🥂
Could you tell us the name of the Judge, at which court, and a case reference number please? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
