So an at-fault claim, paid by your insurer.I had made a claim on my insurance due to a collision with a wild animal
Some probably-related mechanical issues post-repair, repairer not taking responsibility. Escalate through your insurer.car was collected and supplied with courtesy car the was repaired by an approved repairer it was returned visually looking great and was repaired in great time.
Later after having the car back I had realised that something wasn’t right and my car was overheating causing My oil temp gauge to rise while idle , air con wasn’t working to great either... very noticeable in August heatwave last year, with this happening I had also noticed another new sound coming from the engine bay so I dug further to realise my car fan wasn’t working while idle or at low speeds.
This stated on the invoice of repair that was removed n refitted along with other components in that area so I was straight onto the phone of the approved repairer where they then collected it a week later to inspect.
Repairer had sent to manufacturers to diagnose the problems where they found poor connection to the fan and also suspect of lower engine failure with the noise that became apparent.
Long story short no body took the blame for the engine noise and raised n complained with insurance for 2 months while still sitting at the repairers. Insurance engineer gave the final answer of how my engine noise was down to wear and tear not down to the poor worksman ship on the repair causing an overheating issue which was found n repaired courtesy of their work.
( my car is 3.5 years old 3 litre diesel with low mileage )
Why on earth did you collect it if it was not running properly? So at this point I had to collect my car after 2 months and now try to find my fault with my car when I cannot drive it n let it sit on my driveway
None of that is relevant. After many calls n couple of call outs it seemed it was 100% internal engine failure. Now my car is on PCP and have 18k plus too pay left on it and now I have a non running car. Manufacturers quoted 16k for a new engine... could have sold the car as non runner for maybe 6-7k and lost out 11k and still no car.... my only option here was to rebuild the engine by a trusted specialist which quoted 7k
At this point I didn’t have 7k ... I had to plan to sell my half of the house to release equity ( going though a split prior but wasn’t going to sell ) none of this was available until mid next year due to a early repayment charge oh also 7k believe it or not So I I had to sell valuable items , use all savings , borrow from close friends n family ( promised to pay back once house is sold ) which was very shameful for someone who never asked for a penny off anyone. At this point of my life I had no car , inconvenience with day to day life getting to work n my current lifestyle , also in thousands of debt to owe friends n family and also using my credit card to pay for every day life things and Christmas. All of this caused huge depression, insomnia n anxiety with two trips to the emergency room after aniexty attack and also very high heart pulsations. Guess I never been in this situation before n money really can make effect your mental health that’s for sure.
Yep, an independent report will help your case against the repairer. After securing the 7k I went ahead with the repair and had it repaired in time for the new year. When going to collect it the specialist asked me a series of questions about the engine and how it become overheated and when stripped down water pump n chain was in great maintence n services was up to date. I explained about the repair and he was so shocked and said you would not be standing here right now if it was repaired correctly first time and they are liable for the damages caused.
He has written me a report in detail to send to insurance which they now have and also a copy of the invoice from the engine repair.
Probably. If not, letter before action and small claim.I presume I will be hearing from them soon to reimburse me what I’ve paid for the repair (7k)
That's not a question. But my question out of all of this is ... due to all of this I have suffered huge distress and Inconvience Which was just an emotional time it really was knowing you have thousand to pay out when signed into an agreement n you don’t have it and no independence of using a car was just awful
once paid friends n family off with the money reimbursed I will still be at a financial loss using my credit card , huge expense for public transport for multi things , 4 months without my car which I pay on pcp and 4 months insurance already paid, I guess there is so much more too but cannot stress for what this has caused.
I'm sure you would. But you aren't.I would like to think I’m entitled to compensation from all of this
You are entitled to the cost of repairs - if it can be demonstrated the issues arose through an inadequate repair. You are entitled to direct reimbursement for your costs arising. No more.
You may get an ex-gratia goodwill payment.and I would like to settle it with the insurance if I can...
If your finances are so tight, why do you have such an expensive car on finance?0 -
I agree with AdrianC. You're entitled to the cost of the repair if you can prove the work was needed because the original repair was not carried out properly, so if the insurance company believe your specialist's report.
Everything else is incidental and the best you can expect is a goodwill gesture from the insurance company for your trouble.0 -
Too many people watching American legal dramas where they sue for anything.0

"Hope for" rather than "expect".Aylesbury_Duck wrote: »Everything else is incidental and the best you can expect is a goodwill gesture from the insurance company for your trouble.0 -
You're not getting anything for distress.0

Why have you deleted your post? It might have been helpful for others.
It's also rather pointless, given that it's all been quoted in the replies anyway.0
