    Evening Keith yesterday emailed n180 to CCBC and Claimant today I received an email requesting payment for a pcn which occurred a week ago no vehicle reg no place of offence no name on email seems like a coincidence to me

    Oh, you just had a scam email from another source.  That's a coincidence, I am sure.

    You ask the court to strike out the claim (at the hearing) due to the claimant providing no evidence.  Aare you sure they have missed the deadline or is it just late?
  • Morning Le_Kirk the deadline was yesterday I suppose they might blame covid though

    I suspect this is a precursor to a discontinuation by CEL - the leopard rarely charges its spots.

    I agree entirely and often the courts seem to give the claimant more leeway than a defendant even though the claimant are supposed to be professional outfits that deal with this stuff as their day job whilst defendants are "amateurs" who might do this once or twice in their motoring lifetime!

    They run the risk of a Judge striking out their claim. It's entirely their risk. The same would apply to you if you failed to submit any of the required paperwork on time - potential judgment in default, with ensuing CCJ. 

    The major issue is that while you have every incentive to comply, because the penalty is personal and possibly significant for you, they are issuing claims like confetti as part of a purely business operation, and if a number are struck out, so be it, in the process they will have scared so many other people witless, that money will be flowing into their coffers like a waterfall.
