Undelivered - no refund!

Hi,
On the 24th January, I was at work and I get an email from Hermes stating that my package from Wish has arrived and it was "signed for" by me. I found this hard to believe as I was sitting at my office desk around 9 miles away from home and there was no one else at home as its just me and my partner who was also at work. I scroll down the email to see a signature that wasn't mine above my name. Hermes had forged my signature to complete their delivery.

I get home a few hours later, no package and no card left. Do the usual thing of checking with the neighbours (we only have 2 and both trustworthy as packages have been left with them before) and neither have the package. So first thing I do is contact Wish through their long winded support system and explain the issue. They say to wait and see if it turns up. I waited, it didn't turn up! So I contacted them again to be told that they are unable to refund me for the item as it has been marked as delivered and signed for. I have explained that the signature was not mine and offered to send proof of my signature as well as proof that I was at work when the package was delivered - no response. So I contacted Hermes and they told me they can't do anything unless the seller contacts them.

I have no way of contacting the seller directly as it goes through a Wish representative. I have sent Wish the emails I've received from Hermes and have had no further response from them. It looks like I'm going to end up out of pocket as I can't see this being resolved. The order wasn't expensive, only £25 but still that's £25 I've spent on an item I've never received. Hermes are a total nightmare and I've had issues with them before saying my package was delivered, never received it and got a message from a lady on Facebook saying she was out walking her dog and caught a man in a van dumping empty boxes 2 of which had my name and address on. Luckily that was through Amazon and they refunded me instantly. I honestly don't know how one company can be so horrendous and get away with it!

So please, any advice would be appreciated otherwise I think I'm going to have to just cut my losses.

    Cut your losses. This is what happens when you order counterfeit tat from overseas because you think you're getting a bargain.
  • Is it worth it though? Will I end up having to pay more than what I paid for the item?
  • Small claims court won't entertain a claim for £25. It's frivolous.

  • That was my thought. It's more the principle of the matter.
  • As I said, prepare to cut your losses. If you've managed to order loads of things from them that have arrived satisfactorily you've covered the £25 loss on this one.

    The combination of cheap (sometimes counterfeit) stuff and cheap courier charges is not a good one. This is the consequence.

    If it were about principles, you wouldn't be using them in the first place.

    When I had some issues with a parcel ordered from ebay recently that was / not delivered by hermes ( not hermes fault) I contacted hermes and they were helpful even though I wasn't the shipper . It turned out the shipper had not put a particular code on that allowed me to collect from a third party- a shop.But orderering from China does come with risks. If you order through ebay in future you have better support if something goes wrong
  • Unfortunately not all of us can afford to spend the extra cash to receive a better item or a better service. With that said this shouldn't mean that it gets treated any differently. I've still paid for an item and a delivery I didn't receive. Regardless of how much I've paid for it, the seller has not fulfilled their contract with me and the courier has not fulfilled their contract with them.

  • That may be the case, but enforcing that contract when you're a UK citizen and you're buying under Chinese law, will be difficult.
