New Member: SIP Car Parking PCN Appeal Advice Required

I am looking for advice as I feel that I have been unfairly issued a PCN by SIP Parking.
I paid for a ticket in cash for the full duration of my stay. I took a time, date and location stamped image of this ticket upon purchase - as this is what I always do in case of an issue. I returned to a PCN attached to my car. I then took another time, date and location stamped image of the PCN next to the valid ticket. Maybe too naively, I appealed almost instantly thinking it must have been a mistake as the viable ticket was still in on my dashboard - it had just slipped down the dash making it not visible. To the best of my knowledge it was on display before I left the vehicle for the night. I can only presume that the heavy doors ricochet the ticket down the dash when the door was shut, or the wind blew it, or even a combination of the two. Either way, I had and still have the ticket to this day. My appeal was declined with only the below information to support: "Please be advised, as stated on the car parks signage, it is the drivers responsibility to ensure a valid ticket is on display inside the vehicle in order to validate parking session as the tickets are not transferable. Evidence provided by the ticketing officer proves no ticket was on display at the time of the contravention therefore the PCN was issued correctly." I have since requested photographic evidence and the valid ticket is not visible. I am now at the stage where I am going to appeal via the IAS, but I was looking for advice on how to handle this? It seems ridiculous to be paying a £100 when I had a valid ticket!

    I'm assuming you haven't yet read the sticky thread for NEWBIES that is just underneath where you clicked on the newthread.gif button, and asks you to read it before posting.

    The reason I assume you haven't read it is because it advises you NOT to appeal to the IAS and explains the reason for that advice.

    It's a shame you gave away the driver's identity as well, but that cannot now be helped.

    What happened when you complained to the landowner?

    Have you complained to your MP yet about this unregulated scam.

    You say you think shutting the door or a gust of wind caused the ticket to move, but how do you know that some person or persons unknown didn't bounce up and down on the car with malice aforethought to dislodge it?

    One other thing, please hit enter every now and then as a wall of text is likely to discourage other posters from reading it.

    Apologies, you're right, I hadn't read the thread.

    The company already have my personal details as I had to sacrifice them in order to appeal initially. Evidently, I am now aware that I shouldn't have even done this.

    I have been advised to appeal again through the IAS to ''exhaust all options'' so to speak - in the case that this goes to court, but you think I shouldn't? Should I just await a legal letter now?

    correct , that it the current advice because the IAS is a kangaroo court, not fit for purpose

    [FONT=Times New Roman, serif][FONT=Times New Roman, serif]Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    I honestly really appreciate all your comments. I haven't appealed through the IAS and instead I am emailing the local MP of the constituent in question and my local MP. 

    I was wondering if anyone could provide some further advice. I am not the owner of the vehicle, but the owner has since received a letter regarding the PCN, stating they do not know who the driver is nor the address. The registered keeper must either pay the fine or give up the name and address of the driver or be liable the PCN plus additional charges. 

    Should the owner of the car respond at all?

    No, the Registered Keeper need not respond.
    Instead he/she should wait patiently for their appeal to be rejected and ignore all the debt collectors letters that will surely follow.

    When the keeper receives either a Letter of Claim or official court correspondence he/she sshould post again if they are stlll needing help.

    Thanks KeithP. The registered keeper and the driver are different individuals. The owner has not appealed at present, but the driver had (see initial post). Will it be the driver or the owner who will be summoned to court? 
    Should the keeper transfer the vehicle into the name of the driver?

    No-one will be 'summoned' to court, it's not a criminal court.  It's just a scam firm saying the consumer owes money.
    Should the keeper transfer the vehicle into the name of the driver?
    Only if the keeper is a less robust person and worse placed to face this in court, than a more confident driver.
     e.g. if the keeper is:
    - elderly/vulnerable and likely to give up & pay
    - not very savvy and just doesn't get the legal arguments and will make a mess of it
    - not good at 'public speaking/job interview' type scenarios
    - unlikely to be able to attend court due to a job, or being pregnant, or having 10 children at home, etc!
