  • Do you have anything to enforce a CCJ against - a bank account? some assets in the UK?

    Or do you know if he is intending to come back to the UK?

    If not, the court process won't help.

    I can use a CCJ to issue a warrant of control and use a bailiff.
    I believe he's not abroad anymore, now he lives in UK.
    I have sent a Letter Before action to my former place where he still goes to pick up his mail regularly.
  • If you can't tell the bailiffs where to go, the bailiffs won't be much use !

    The CCJ is potentially quite a problem for the landlord as it could stop him from getting credit, but if the CCJ goes to an old address he might not find about it for some time.

    Might be best to try a tracing agent before spending too much money and time on this.

    Sure I don't mind using a tracing agent if that really helps in my case. Are they efficient though?

    They were when I used them. If he is not registered elsewhere they may not be able to trace him but they succeeded 3 time out of 4 with me, the 4th had not registered anywhere or changed the address on their accounts, mail continued to go to the house so at the time there was no way to find another address. Turned out they had done a moonlight and moved abroad.

    You cant apply a CCJ against a bank account only a person
  • The issue is going to be whether you had a valid tenancy, do you have record to show you paid to live there and that you weren’t a lodger?

    https://www.gov.uk/make-court-claim-for-money/enforce-a-judgment:
    The court can freeze money in the debtor’s bank, building society or business account.
    Download and fill in a request for a third party debt order form N349.
    The court will decide if money from the account can be used to pay the debt.
