Amazon gift card

Hi there,

My mum bought my girlfriend a £40 Amazon voucher for Christmas just gone. She ordered the ones that come through the post. It arrived in a sealed box and remained that way until my girlfriend opened it on 1st January when we went to stay with my mum. But when she came to redeem it, it said it had already been allocated to another account!

We've spoken to Amazon on numerous occasions and they've essentially told us that it was allocated to someone else they can't recover the money and it's our loss! I've proved that I have the card as well in pictures. We are now £40 down and I don't understand how this happened because, as I said it arrived sealed and stayed sealed until my girlfriend opened it. It must have been someone at the warehouse is all I can think and surely they have the address of the person who stole it because it's allocated to an account which will obviously have an address attached to it!

Does anyone have any ideas on how to proceed? Surely this isn't right that we should have to absorb the loss just because there's a thief in their crew?

    Alternatively ... someone else received an Amazon gift card, used it, typed in the number incorrectly and coincidentally typed in the code for your GF's card.

    That would be incredibly unlikely (if it weren't, everybody would be trying to "accidentally" use somebody else's giftcard).

    No, you don't have any rights or your girlfriend.

    Only person that has rights is the purchaser, your mother.

    Who has been speaking to Amazon, you, your girlfriend or your mother?

    If Amazon have stated that it has been allocated to someone else, keep pushing them for a refund, though they will presumably argue that your mother gave it to someone else.

    How did your mother pay for the gift card?

    Don't start chucking accusations of staff theft around. You have absolutely no evidence of it and they may just cancel your mother's account permanently.

    So was the scratch pad already scratched off?

    Because if it was not, how would anyone know the details to type in?

    There was nothing you scratch off, it was a sticker you pull off.

    Am I assume no one knows what my mother's rights are or where I should take this?

    It's not as simple as anyone knowing what your mother's rights are. She has a right to expect a new and unused gift card for her money. Amazon have a right to expect that the gift card will be used once and once only. As it stands, there's a dispute whereby Amazon are saying it's been redeemed already and your mother is saying it hasn't been. Well, not by the intended recipient, anyway.

    She could try a LBA and threaten court action but for just £40 it is probably not worth it and would be considered a frivolous claim.

    In summary, it's up to her how far she wants to take it, but there is no magical legislation that is going to entitle her to an automatic refund.

    Strange. Every one I've had has been a scratch panel.

    Might be worth asking Amazon the question on how the code is covered.
