Lcwra confusion

Just wondering if someone could please help me. I am driving myself mad looking all over the internet for a answer. I first started receiving universal credit in may 2018 and also was providing fit notes. October 2019 I was finally put forward for the face to face assessment which I had in December 2019. On January 10th 2020 I received a letter in my journal to say I had been awarded lcwra and any backdated money would be from the 13th week I first provided evidence of my illness. I have since had a letter today saying I was owed £3337 dating from 28th July to 27th December 2019. But it also says in the letter they have already paid me over £2000 so they only owe me £700. I really don’t understand this. I’m sorry if I sound stupid but could someone please help me understand.

    Do you claim any other benefits, like New style ESA as well as UC?

    The letter says they owe you £3337 but after taking away £2000 they owe you £700? This doesn't add up. So you have been awarded 17 months of backdated LCWRA which was £328.32 per month from April 18 and £336.20 from April 19, so that would amount to over £5000.00.

    Also, the element is awarded with UC after 3 'full assessment periods have been served, not after 91 days, that's an ESA qualifying period?

    I would ask for a detailed explanation of the calculation.

    That's why i asked if the OP claims New style ESA as well as UC.

    It's awarded from the start of the fourth Uc assessment period isn't it ?
  • Sorry for the late reply. No I didn’t get any type of esa. I have just been getting normal universal credit and child benefit.

    They said they owed me £3449.27 but have already paid me UC of £2712.05 from 28 July - 27 December 2019?? (Which I don’t understand because my payments have never changed)
    And because of this they only owe me £737.22.

    I’m really struggling to understand this because I have been supplying fit notes since may 2018. I don’t get how they have given me £2712 and after looking at my payments they have now changed my 4th January 2020 payment to include lcwra benefit ?? How if I wasn’t paid it. I’m sorry if I’m not making sense.

  • the Decision letter regarding the award of LCWRA is a real failing of DWP communication as it does nor specify from when the LCWRA is being paid nor how much. Invariably there is no journal message from the Case Manager indicating these details.
    I believe it is enshrined in legislation regarding the 90 day waiting period, so yes, no LCWRA is paid until the 4th full UC AP after the decision to aware is made ... whenever that is
    The letter is equally vague in that respect.
    The OP needs to send a journal message to the CM ( indicate the message as 'payment' ) requesting if not demanding a breakdown of how that payment is made up and particularly specifying as to what the 'over-payment' is
  • Thank you all so much for replying. I am going to go citizens advice tomorrow and just find out where I stand and then I am going to contact universal credit. It’s just so confusing and UC are so unwilling to help. Thank you all.
