But you did get what you wanted. Parking for a set period at a specific location.

What you didn't buy was parking not using a specific company

Its debatable whether the right to cancel would apply to car parking.

As stated, legislation words it as:
(h)the supply of accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities, if the contract provides for a specific date or period of performance.

Its not accommodation, transport of goods, vehicle rental services or catering. So that leaves "services related to leisure activites".

Now people may get parking so they can undertake leisure activities. But does that necessarily mean that all parking is a service related to leisure activities? You'd need a court to give you a definitive answer to that question and for the sums likely involved, its probably not going to be worth it.

urr, OK. I think this whole website is about getting good value for things so that seems slightly surprising advice.
That's why that advice wasn't surprising and was entirely accurate. As you've discovered, price and value are different things. You literally bought cheaply and paid twice. Where's the good value in that?

Yeah, I don't mean that the credit card company is in the wrong - more that they might not want to be associated with an illegal operation.

Banks & Card providers are not regulators of retailers. They have no right to block a company. They are not associated with them other than the fact you used them.

The companies merchant bank would have the right to close their account if they were getting lots of chargebacks, or felt that their trading was not legal.

A quick look at their About us page brings up this gem in the 1st line.
    Welcome to Merry Packing
T/C make it Quite clear what they are.
    1. Booking Conditions:
1.1 Merry Parking is ONLY a Booking agent for the featured car parks on the website. You will be contracting with the individual car park (The Service Provider) and will be subject to their Terms and Conditions which may contain exemption clauses and limit each company窶冱 liability. Full details of these are available from the individual car park provider.
Merry Parking staff DO NOT DROP or PICK vehicles at airports. Merry Parking DO NOT own any of the car parks which are featured on the website.

TBH. If looking for airport parking. Look on the airports site. They should list the ones that are trusted.

While parking may possibly be exempt from the right to cancel, its not exempt from the information requirements that are to be provided before the consumer is bound by the contract.

Part of that information includes the identity of the trader - if they are acting as an agent then they are not the trader. They cannot change that except by agreement.

Looks like OP has just been given another possible (if what OP says is correct they didn't inform until after booking who would be providing/who they were contracting with) avenue that is a lot clearer than "services related to leisure services".

  • To clarify - you did change your mind about the booking; reading reviews after booking resulted in your changing your mind. :)

True ... but OP says if they'd known who they were contracting with they wouldn't have engaged the contract in the first place, thus negating the need to cancel. :)

    You made a purchase.
You were not told/sure with whom it was.
    You didn't check or ask.
When you found out you changed your mind based on poor reviews and requested a refund.
They said no and would only offer a part refund.
Assuming that is all correct I don't thin you have a leg to stand on. Do your research before you book and if the you can't find out who the parking will be with go to someone else who will tell you.

There is probably a reason why the name is hidden so you don't know the car will be parked in a field of mud when it is not being joy ridden!

I disagree ... the contracted party's name was only divulged after payment. Therefore I'm minded to agree with post #16.

OP could have done extensive research, but of whom? Until they'd paid they didn't know who there provider was.

Or was it that the details were shown before booking but the OP only saw the cheap price and didn't look into it any further?

When going through the booking process, you give the dates you require then a list of parking services is displayed and you choose which one you want.
This list shows the companies who will be providing the parking and if you click on the "more info" tab, you can get a lot more details.
