Parking eye Popla golden ticket?

Hi,
I have used this site and the forum on a number of occasions to successfully challenge parking charges. My latest attempt at this is on the back of a charge notice for a parking 'event' on 20th December. The notice was 'issued' on 28th December and I received the initial notice in early January.
I have challenged the penalty through Parkingeye and received an email today confirming that my appeal has failed. The basis for my challenge was that they had sent the notice to the keeper, not the driver and that it was received outside of the 15 day period.
I have a POPLA code now and am looking through the forum to put together a challenge to them.
The reason for my post is that I think I may have a 'golden ticket', but I'm not sure how valid that is in 2020. Most of the successful challenges that I have read are 2 or 3 years old.
Can someone please confirm whether it is still a valid defence to use POFA?
Many thanks in advance.

yes it is, POFA has been here since 2012, so a goldent ticket popla appeal based on similar ones on here is fine , try and find the most recent one
its always going to be that way , unless parliament amended POFA
and PE did not issue a penalty notice, I am sure you will find it says Parking charge notice, or PCN0 -
My bad......
I have just had another look. I had the initial NtK and then a reminder and thought that the reverse of both documents were the same.
Unfortunately, for me, the initial NtK does refer to the POFA. So I guess I don't have a golden ticket.......hey ho!0 -
agreed ,Parking Eye to tend to issue them promptly, they know all about POFA
only the NTK will mention it , not the reminder0 -
Without a golden ticket you will need to concentrate on things like signage, BPA CoP failures, grace periods, no standing to issue charges and anything else you find in post 3 of the NEWBIES.
What happened when you complained to the landowner?
Have you complained to your MP yet?I married my cousin. I had to...I don't have a sister.

PEs signs leave much to be desired, read this,

A couple of PE court claims have been lost recently because of this.
Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -
I have just done a little research via the council planning site and sure enough, there's no planning for signage or the erection of pole mounted cameras. I will write to the planning office tomorrow to check, but things are looking up 0

This will have no effect whatsoever on your PCN - it is something solely between PE and the council. If you have the resilience and drive to agitate with the council (which might take some months) the best you can hope for is that PE are asked to apply for retrospective planning permission which, almost inevitably, will be granted 'on the nod'.
Even the criminal case of no advertising consent (which cannot be retrospective) in cases where this has been raised, councils have simply brushed the issue under the carpet. ANd again, will have no bearing on your PCN.
If you want to chase shadows, the above are two great ways of wasting your time.
Sorry for the bluntness, but you need to concentrate on activities to help you directly fight your parking charge. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
