There was a deal promoted on HUKD a few years back, where you could order a mobile WiFi dongle together with a rolling mobile contract at zero initial cost. The dodge was to cancel the rolling contract as soon as you had the hardware.

I cancelled the rolling contract properly, but the mobile company placed late/non-payment markers on my credit file, until I contacted them again and insisted that they mark the account "settled." Had I not done so, I could be in the same position as the OP.

Which bank flagged the inconsistency and what was the reason given?

It was Barclays themselves, and the inconsistency related to the time I'd stated I'd lived at my current address. I got a "refer" status under that field from my National Hunter report. Interestingly enough under that same field for every other application I'd made everything was all fine, so it was something specific to the Barclays application. When I went to follow up with Barclays I got a generic response from them so I gave up on it. Only really wanted a Barclays account to milk them for the Blue rewards anyway.

@OP - it looks like your SAR has unearthed something that's probably the cause of all your issues, but it'd still be interesting to see what National Hunter has to say, if anything else different :(

Did it give you any problems?

    Update,

I went to my local EE store and had a conversation with a representative from the collections department. I was informed about the unpaid balance for a old mobile phone contract from 2014 long story short I paid the the outstanding amount in full.

The account was opened in may 2014 and they placed a Cifas marker for evasion of payment in September 2014, 4 months later.

Do EE have any sort of responsibility to notify me that my bill hasn't been paid They said they had sent letters but haven’t received anything. The rep in the store also confirmed the last correspondence they sent about this was in 2016 . And I can assure you I haven’t received a thing.

I also spoke to someone from Cifas and they confirmed the marker was placed in September 2014 so it’s due to be deleted from their database in September 2020. Funny though because during that time I’ve held several jobs in financial services that required rigorous background checks opened bank account , credit cards insurance etc.. I can’t understand how it’s never flagged up before ?

Shall I contact EE to remove the marker early or wait until September?

It'd be worth getting in touch with EE to complain about it. I'd also be tempted to suggest submitting a SAR to them to get details of the fraudulent application (including mailing addresses) and copies of any correspondence that was supposedly sent. If you aren't likely to need credit anytime soon then it'd probably be easier to just let it lapse, although this won't solve the issue where you'll likely be internally blacklisted by EE - that'd be an issue for you to determine.

It's caused problems in the sense that I appear to be internally blacklisted from Barclays, but outside of that there appears to have been no lasting effect

I don't understand why the placed a cifas. Not paying a mobile monthly payments leads to default and CCJ. Shouldn't be a cifas. It's not a fraudulent.

Is there a cifas category for evasion of payment?
  • Yes.

According to the CRA’s the default was registered on the 5th January 2015 however, the Cifas marker for evasion of payment was placed on the 14th September 2014.

I don’t understand how a Cifas marker can be placed for evasion of payment before the account has gone into default?

These mistakes can happen to innocent people and can have devastating consequences. You will get this removed, it will just take some time unfortunately.
