Item didn't arrive on time. What are my options - ebay

I bought some shin pads for my son who has started hockey. I made the purchase from a "uk" seller and delivery estimate was 17th. They didn't arrive. So on 21st I checked the tracking with royal mail. They said they hadn't received them and most likely that the seller just created the tracking number but never finished it and posted the item. So I needed the shin pads and bought them elsewhere. I messaged the original seller and said I wanted a refund.

They say they want me to wait as the item is in transit. I said I had bought some more shin pads and I didn't want them anymore. I looked at the tracking number still says the same. The parcel arrived today with a royal mail 24 label on it.

So at this rate I am stuck with 2 lots of shin pads. It's not fair cancelling the other order as they haven't done anything wrong.
I did open a eBay claim on 21st when I first suspected there was a problem and when I asked to cancel the order

    The basic delivery confirmation numbers available on parcels doesn't update until delivered so is no indication of where item is or when it was posted. I have no idea who you spoke to at RM but they obviously don't understand how Rm24 works.

    As you now have the item, and assuming this was from a business seller then you can open a return request, but you will have to return at your own cost. Obviously you need to close the INR , but that won't affect your ability to,open an INR.

    Royal mail said they hadn't received the parcel on 21st with that tracking number. It turns up today 2 days after I flagged it up with a royal mail 24 sticker on it. Does that mean that they have only just posted it when I flagged it with them.

    I don't think the original order got posted, they generated the code and then forgot to post it. I flag it up and tell them I want a refund they rush out and send it by royal mail 24. Original tracking number still says the same.

    I am cross cos I said I wanted a refund/cancel and I think they just trying to blag me saying it's on its way. It isn't worth much so it's going to cost me as much to post back if I have to track it.

    I use Rm24 and RM 48 and if I input my parcels sent today it comes up with a message that says something like we have no info on this number and it will only update once delivered. It doesn't mean the number is fake or that item hasn't been posted, RM24/48 is not a tracked service. Nothing at all shows with my numbers until a few hours after item has been delivered.

    I do get the occasional person ask me why I haven't sent their item, or why I'm using fake tracking numbers but I just explain how the system works, and most are then happy.

    If you want a service that shows when item has been posted then you need to use signed for or special. Even signed for is not fullly tracked and as I use a mail centre I don't even get an acceptance scan when I use signed for, and just like my standard parcels nothing at all updates until item is delivered.

    However this is all a bit of a side track for the OP, as per my earlier reply if it was a business seller then OP has a right to a change of mind return but will have to pay return postage costs.

    Your number when input into RM track and trace shows it was dispatched on the 14th January at 8.11 am . (Scroll down the page) So this looks like a delay with RM as the estimate of the 17th should have been achievable, but it is not the fault of your seller.

    It matters not when it was posted, just that you now have it.

    If you paid with PayPal you can try to retrospectively register with their Returns On Us programme and try to return under that. If you can, Paypal will reimburse up to £15 towards your returns postage. Make sure you send it tracked.

    It is all immaterial anyway, If this is a business seller you can return it at your cost merely by requesting a return.

    I'm not sure what else you expect to do, you obviously can't keep the item and expect a refund.

    Your OP says that you have the item
    "The parcel arrived today with a royal mail 24 label on it."
    so your only option is a return.

    We all know RM tracking especially for these untracked services can sometimes fail to update . RM24 is also NOT a guaranteed service.

    Incidentally for those users not aware of the RM24/48 service (and some business sellers might be interested as it gives delivery confirmation on large letters) the basic info is here, https://www.royalmail.com/business/shipping/uk-services/royal-mail-24-48

    It is not tracked nor is it guaranteed and you don't get anything to show that RM have your item.
