A set aside returns the status of the claim to the defence stage. It's very unusual for a court to boot out the claim entirely and even less usual for a claimant to drop the claim.
So the decision about the offer is
Will i pay £100 to get the judgment set aside or will i hold on in the hope that they have to pay the set aside costs ?0 -
Just quick update.
I got final offer which I've accepted.
£100 court fee for set aside with consent plus £100 settlement sum and they will deal with everything.
CCJ will be removed which was the main issue here.
I can not afford to lose more time/money/energy on this.
