CCJ for old address and PCN for using my neighbours bay

    Wow.
    I can't believe they are so incompetent.

    So on the website it states their company number is 8307156 which belongs to different company.
    When I searched using their name their number should be 08307516.
    And on top of that on sign there is also wrong number 8307526!

    I don't have original PCN.
    I requested it writing SAR request.
    But it is going to take them ages to respond I reckon so I won't know exactly what was on the PCN.

    I'm going to ask DVLA now about who requested data. Do you think they will have company's number? If they say they requested it and there was wrong company number does it change anything?

    Is such mistake fair ground to set a side plus wrong address?

    Is this right order to draw defence:?

    1. Wrong address.
    2. Wrong company number on their website, sign(perhaps on PCN as well)
    3. Using neighbours bay with his verbal permission.
    4. Anything else?

    DVLA will not have the company number but you may as well rattle some cages and point this out and ask the DVLA what they are playing at giving out your data to this lot:

    (a) The claim not being properly served, and
    (b) you acting very promptly when you discovered the CCJ and
    (c) you having prospects of successfully defending the meritless claim...

    ...will be what you take to the set aside if there is a contested hearing, but Henrik777 always advises one thing to try first...as you will have found when you read all his recent posts like I advised!

    I am not saying yet what that first step is, we want you to learn then tell us.

    I asked DVLA for company number so we will see.

    I didn't need permit as the bay was allocated to my flat so never had to display it.
    I only got permit for visitors and that could be used in few bays.

    And yes I'm trying to follow Henrik777 posts but this like needle in a haystack.
    But still trying!!

    It says cars can be parked with 'authorisation from the landowner', and you did:
    Sometimes when I had visitor I led him park on my space and I parked on my neighbours bay which I had verbal permission to do so as he didn't have a car so he led me use it all the time. So I did occasionally.

    Errr, you just click on his username and 'view posts'. They are ALL about set asides.

    Look what I said in post #4 and post #6:
    Then read all the posts by Henrik777 about set asides (click on his username in the members list and start reading his advice). He knows more than most of us about this specific subject IMHO, and has been on pepipoo forum and Legal Beagles for years.
    That's why you need to read Henrik's advice on his posts. It will take more than one afternoon, so put aside this week to get your head round the options.

    ok rephrase time the "permit" you had or was not given , dud it have a bay number written on it

    did you (and your neighbour) have to apply for a permit or was it a case of if you owned property your lease or whatever said you could park there

    hypothetically , what would have happened if you had sold your car to your neighbour , do you have to give parking co your new car number?

    Ok. I'm looking into Henrik777 posts and I think I know what you refer to now.

    Although we are going into proper lawyer language which I could struggle to understand in full.

    On the bay there was flat number and this was maisonette so I had own carport. There were only 2 maisonettes on that residential, one mine and second belonged to my neighbour I mentioned before (always empty as he didn't have a car). So only me and him could use our bays without permit as I did for whole time I lived there ( almost 2 years) and no one has questioned it where everyone else had normal bay where they had to have some kind of permit displayed all the time. It was case when I was told by letting agency this is my place and I don't have to display anything.

    Yes you are getting there.

    Mandatory set aside - but in those cases, Henrik777 says to ask the PPC something first, and not just spend £255 court fee on N244 set aside.

    do as such , your bay and neighbours bay were not numbered or the responsibility of the parking co , they were on your land and not like rest public access (on rd)

    your bay and neighbours bay were not numbered

    and you had landlords permission , and this was granted by 'authorisation from the landowner'

    So I'm contacting first PPC (New World Facilities or Gladstones?) if they willing to set aside with consent.
    Should I only mention about what Henrik777 says regarding CPR 13.2?
    Or should I add all circumstances mentioned earlier like wrong company numbers and having permission from landowner?
