Well done! Did you claim costs? A telephone hearing still requires time to "attend", so ordinary costs are still in play.

Fantastic to see that judges are now getting wise to the fact that the POFA only allows recovery of the stated amount and nothing more. This seems to be becoming a slam dunk sure fire defence when properly argued.
Next step would be to test whether at any point in the process demanding more than the original stated amount is illegal.

    Hi,
No we didnt ask for any costs but after id put our defense across, the judge mainly wanted to chat to the defendant himself and he summed up pretty quickly, said his farewells and went. I didnt want to jump in at the point asking for expenses. Maybe a bit naive but it was a bit nerve wracking and was just pleased it was dismissed.

Excellent, did you ask for an get any costs?  Just seen later posts that you didn't get the chance to ask - still an excellent outcome.

    Did you receive costs?

They have wasted your rime, now waste some of theirs, read this and consider your options, for the price of a stamp you could cost them a considerable amount of money.  .

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
