You have a paragraph between 7 & 8 that is unnumbered. Length of defence is about right as it includes the "latest" version of Abuse of Process.
  • Thanks Coupon Mad and a Le Kirk, I've updated those two bits and I think I'll get it sent off now. don't want to miss the cut off date!

Not much risk of that. :D

    Post #3 above told you:
...you have until 4pm on Monday 17th February 2020 to file your Defence.
    Email is almost instant.

Add in admitting you were the driver and you paid & displayed in good faith.

I would delete #3 (not needed) and replace it with the above instead.

  • Hi - how long would I normally wait until I receive the Directions Questionnaire? MCOL has marked my defence as received on the 06/02/2020.

Your defence is sent to the claimant by CCBC and they (the claimant) have 28 days to respond to CCBC but who knows when the defence was sent to claimant?

Hi guys - are the courts being more lenient with response times? Given how long it's been now since they marked my defence as received 06/02/2020 am I likely to hear from these guys again?

You need to download a DQ and email it to the court, for peace of mind.  We do advise that...

Hi all, sent the DQ but it has been returned today with comments:
"Please find attached your Directions Questionnaire which is returned to you as the claimant has not informed us whether they wish to proceed with this claim.
The Court will notify you if a Directions Questionnaire should be filed."

How long do they get to decide if they wish to proceed? I presume indefinitely?
