Working on a bank holiday

  • I work for Boots and have been in a similar situation. Your holiday hours are your regular holiday entitlement and bank holidays together. I worked in a flagship store and my line manager made me work every single bank holiday including boxing day and nobody else in my team had to work them so wasn't thrilled about that but working Bank Holidays was part of my contract so I sucked it up. For every Bank Holiday I worked I should have had a day's holiday to take at another time but my Manager point blank refused this and I was paid 'double time' and had the holiday taken from my balance.Thankfully I work in a different store and have a much nicer manager now.

That makes it sound as though actually you get statutory holiday entitlement plus discretionary bank holidays and that if you actually work on a bank holiday you get double pay.

As long as you do get your statutory holiday, that would look as potentially a not totally unreasonable scheme.

No, according to my contract, if you work a bank holiday you will have holiday to take at a later date but my then Manager refused this. Thankfully I changed stores and don't have to deal with this now.

So your total holiday entitlement (including the BHs) is simply the statutory amount?

Total holiday entitlement is regular holiday days + Bank Holidays. If you work a bank holiday then your entitlement should remain the same so you take those hours at a later time.

I understand that but if you would still get your statutory entitlement without the bank holidays then it would not be unlawful. The question was trying to find out whether "regular holiday days" is actually "statutory paid leave".
