thanks both.
For them to justify the cancellation fee and I am just cancelling the hotel and its not flights (as I understand they have to pay upfront for flights), would it not depend on the specific hotel policy of cancellation to justify me paying the cancellation fee?0 -
It also says on their website for this specific hotel I booked it is free cancellation on this hotel?0

.........But as has been pointed out to you OTB have terms and conditions which you would have ticked to say you accept - and that includes a fee payable to OTB even for free cancellation.0 -

No, as you will have clicked on a box for your initial online holiday request indicating that you have read and that you agree to the terms and conditions.
It is the OTB T&C which you are bound by, not any that the hotel has.
Regarding your cost breakdown, if they called you following your booking request to say the packaged trip had increased in price and it was at that point you said only to book the hotel and transfers, then I don’t understand why they are charging you the £150 cancellation penalty. This should only apply if you had a confirmed booking. If they could not book the original trip and the original price it should not have been confirmed.0 -
BTW - this thread is on the wrong board. I’ll ask one of the board monitors to move it.0

You might be entitled to cancel your package holiday without a cancellation fee if the holiday company significantly changes the holiday or puts the price up after you book.
1. I booked online then they increased the prices?
at that point (for your web booking) you would have stated that you did not want to pay the new price and you would have paid nothing
The cancellation fee is not related to that...it is related to the subsequent booking that you made that you have changed your mind about
the terms you quoted look the same as the ones you will previously have read and agreed tosinofrench26 wrote: »Cancellation Fee (£30.00 pp) £150.00. (Whats this for?)
Cancellation of booking outside of 28 days Suppliers/Principal’s charges + £30.00 per person, with a maximum charge of £150 administration fee to OTB
You say the suppliers fees for the hotel is £0 so only the OTB charge to pay
Looks like the transfer was non-refundable so the supplier fee is £51.050 -
If the consumer (OP) was not made aware of the terms and conditions of the new transaction until after booking then I would have thought it is an unenforceable contract. The terms and conditions are an important part of a consumer's transactional decision and must be disclosed before any contract is entered into. If the consumer had been aware up front what the cancellation policy was they may not have gone ahead.
I'd speak to someone at the citizens advice consumer service and see what they suggest. You've got nothing to lose.0
