Hi everyone

I hope someone can help me and perhaps you will tell me I told you so. I should have checked but was so desperate for a holiday. So I booked a holiday through this website and the confirmation kept saying pending. They then text stating I had to call them. When I spoke with them they stated that the holiday is gone but they can help resolve then asked for £1000 extra! I then asked hotel and transfer only and they said Iw as getting good deal with that. I booked my flights separately. I was not told about the cancellation policy over the phone or anything else. I then got email confirmation with terms and conditions.

I was curious if it was cheaper to book with hotel and it was by hundreds. So I then checked cancellation policy as didn't place much of a deposit (£38) and the company stated that they will charge me £162 for cancellation fee!

Do I have any argument or rights here?

Please help as I think I made a silly mistake.

    it is common for the remainder of the deposit to be due if you cancel and have only paid a low deposit or admin fees to be added
    you need to weigh up whether it is worth the loss of deposit v's the savings booking direct with the hotel...if the savings are 'hundreds' then it sounds like you will still be better off (have you factored in transfers?)
    were the terms and conditions different from the ones had already read and agreed to when you made your online booking request?
  • I will save if I cancel but I didn't book online as this was all done on the phone. The cancellation policy was not informed t me on the phone and I only read the details after they sent me terms and conditions on email

    Cancellation Fee (£30.00 pp) £150.00. (Whats this for?)
    Total cost to cancel £201.05
    Payments made to date £38.54
    Payment amount due £162.51
  • So for a holiday t be cancelled and not used I will have lost £200
  • The holiday is not for another 60days or more days as well so its not like Im cancelling last minute. It was booked over the phone only 3-4 days ago

    11. Changes and Cancellations by You

    Any cancellation or amendment request must be sent to us by accessing your booking online and will be processed by our Amendments Team. Please ensure that you have received written confirmation of any changes to your booking prior to travel. Whilst we will try to assist, we cannot guarantee that the Supplier/Principal will meet such requests. Amendments and cancellations can only be accepted in accordance with the terms and conditions of the Supplier/Principal of your Travel Arrangements. The Supplier/Principal may charge the cancellation or amendment charges shown in their terms and conditions (which may be as much as 100% of the cost of the Travel Arrangements and will normally increase closer to the date of departure). In addition, you must pay us an administration fee as set out in the table below. We will notify you of the exact charges at the time of amendment or cancellation.

    Add Passengers to the booking Supplier/Principal’s charge + £50.00 administration fee per person to OTB
    Remove Passengers from the booking Supplier/Principal’s charge + £30.00 administration fee per person to OTB
    Cancellation of booking inside of 28 days Supplier/Principal’s charges + £150.00 administration fee to OTB
    Cancellation of booking outside of 28 days Suppliers/Principal’s charges + £30.00 per person, with a maximum charge of £150 administration fee to OTB
    Please note:

    - Some Supplier/Principals do not allow changes and therefore full cancellation charges will apply;
    - Administration fees are non-refundable in the event you cancel your booking.
  • citizens advice state:

    You might be entitled to cancel your package holiday without a cancellation fee if the holiday company significantly changes the holiday or puts the price up after you book.

    The answer to that question is no, they didn't increase the price.

    The product was not available so you bought something else.

    There is no cooling off period for travel products.
    All shall be well, and all shall be well, and all manner of things shall be well.
