CCJ, NE Parking/Gladstones solicitors

Hi
Iv recently gained access to my credit file as I hoped on becoming a first time home owner this year, however there is a CCJ on there dated back to 2017, the address linked the this is only half correct as the street name is correct however the post code is my parents address
I have contacted the county court to get further information and this goes back to 2016 where there was PCN issued by NE PARKING - these are represented by Gladstones solicitor so the court advised me to contact the solicitors directly to get further information
I then spoke with Gladstones who gave me dates of the parking and the reg of the vehicle And the PCN number
The car I had at that time was a company vehicle registered to my place of work therefor all DVLA information would direct them to the company I work for
I have spoken to my head office and they have sent me proof of the payment being made to NE Parking along with details that they cashed the cheque and a bank statement that the funds left the bank
I have spoken to Gladstones on Numerous occasions they seem to be quite helpful, they requested all the evidence of payment which I have sent via email, they also said I was sent letters in 2017 which I did not receive due to address being wrong, but even still the car is not registered to me so I’m unsure how they gained any details of me in the first place as my place of work would not disclose this for a PCN
They have advised that they will go back to their client with the evidence then get back to me
I’m not feeling hopeful
My question is now that they have all the evidence will they proceed to the courts to have this CCJ removed from my file? Or will I still have to fill in the N244 form and be out of pocket of £255 to request this myself?
I really wish to take matters further, the last 2-3 Iv struggled financially and was denied any help with consolidating debt etc which all makes sense now due to this CCJ, can this be taken
Further or will I be lucky to even get an apology?
Any advice greatly appreciated xx

These people are hard to fathom out. In the face of such evidence it would be ludicrous to not concede and fix their mess.
I would imagine you'll end up having to lodge an application yourself. Do you give them a deadline or did they give an estimate of how long ?
You'll be lucky to get an apology.
I'm guessing someone gave them your address. They'd be in a spot of bother if they found it out themselves by nefarious means.0 -
I read your other post in other forum , how the hell dud NW or gladrags get your name?
company car? and you say they paid it ? once this us sorted I would be asking questions of your company0 -
It’s a huge organisation I work for and they have explained due to company policy they would never under any circumstances give out my personal details for a PCN, the funny thing is the details/address was incorrect anyway I have no idea where they would get these from0

I asked them to get back to me by Friday gone which they haven’t, I will call Gladstone’s again today and see if there is any updates (not holding my breath) Iv read through other post and this seems to happen a lot it’s a disgrace really0

I would suggest that the charity you work for gave your name and address , lets think logically , the DVLA do not know who is driving , the police dont , the insurance database would be a block company policy
I would suggest that the young girl in the office wrote your details on the parking notice to cross reference it , then faxed it over to the parking co
go and ask the department that deals with this to state your full address , as there files may be wrong and that would show the link
now I said the charity you work for YES , no company I have ever worked for has paid speculative invoices without checking legality , and if they deducted it from your salary , I would be asking why you were not allowed to appeal it0 -
1) when precisely did you discover the CCJ? Date needed
2) You have a maximum of 21 days, at the absolute outside, to get your applicatoin into the court. You CANNOT wait on Gladstones making a decision; if you delay, you lose the chance to get a sert aside with anywhere near the successr ate we're used to
3) If you have an email address for them, use it to sned them TODAY a requirement that they
a) agree to a set aside by consent, wiith their client being responsible for the costs of making the application and in drawing up the consent order
b) they apologise for their (clients) error, and explain how their (clients) data processing failed so badly
c) that they make clear to the court that THEY messed up as the PCN had been paid, and they fully accept their mistake in raising a claim for a settled PCN, as their statement of truth particulars are clearly false.
You require this within (suitably short deadline - id say 3 days)
State that, if they do not consent you will apply for a set aisd ewithout consent, costing £255, and you will not only claim this amount back, you will apply for the claim to be summarily struck as an abuse of process - their client has knowingly claimed for an amount they are not entitled to. You will apply for your costs of attendin ght ehearing, AND you will apply for full costs due to their cliets appalling behaviour
You will also then raise a counterclaim for th eprovable damages - cannot house seek until this is done meaning x months more renting etc - plus the DPA2018 violation in processing data for a closed PCn, etc. This wil lbe at least £750.0 -
Nine times out of ten these tickets are scams, so consider complaining to your MP., it can cause the scammer extra costs and work, and in some cases, cancellation.
Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies. You never know how far you can go until you go too far.0 -

The parking ticket was in 2016, My memory isn’t that good and they would have asked me first to take the payment from my wage, all procedures were followed correctly, the company I work for have all my correct details therefore have no reason to give an Address I used to live at with the incorrect post code, there has been absolutely no correspondence to myself or the company I work for regarding this, they would have advised me of the ticket, Iv agreed for them to pay, which they have in time, that’s that really i can’t understand how Iv been give a CCJ in the first place, maybe an admin error on the parking companies side therefore they should sort this out really0 -

I have only just gained access to my credit file this month and notice the CCJ it dates back to 2017 so I’m way passed any deadlines to appeal the CCJ
I don’t have an email address for NE parking I was advised by the court to speak with their solicitors Gladstone’s, I have an email address for these and been calling daily for updates
I will email them again
Thank you for your help0 -
