ParkingEye appeal denied twice. I now have to appeal with POPLA

Hi,

Last month I received a PCN to an old address. This place is question is a driving range in London. I had never been before and didn't see any signs ( it was dark ) saying anything about parking restrictions.

I purchased 200 balls and stayed for just under an hour BUT wasn't made aware by the clerk that I had to fill in my Registration number at reception ( They are supposed to ask if we arrived by car, we obviously had as we had all of our clubs with us ).

I sent a screenshot of my bank statement as an appeal but was denied twice. They are now telling me to appeal with POPLA but I feel like I am destined for the same fate.

Any advice ?

Appeal to PoPLA. If that fails let them take you to court where, imo, they are likely to struggle as many judges regards these claims as trifling.

Nine times out of ten these tickets are scams, so consider complaining to your MP, it can cause the scammer extra costs and work, and has been known to get the charge cancelled.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies.

I haven't yet contacted them as I was hoping the appeal process would just immediately get thrown out.

The golf range is the Greenwich peninsula. I'm not too sure on how to approach them, by ringing them ? Maybe socials ?

I would explain to them that I was a paying customer who had not yet been to their site and the parking restrictions weren't explained to me and I am being harrased by their agent ( ParkingEye ) and will be not returning and will recommend my friends not to go there due to my experiences.

If the car park belongs to the driving range and they are un-cooperative, write bad stuff on their Facebook/TripAdvisor pages.

    sample review
I was a regular to this place, but now its too crowded & the booking process a bit too cumbersome.
I'm a member & I have had instances where i would book on the phone & then not have my booking for a bay because there was some staff mix up.
On my last visit, I had 3 bays booked for some of my friends were visiting, & we bought 300 balls only t find our bays were occupied. And top of that when we checked in we did inform the staff that of our car reg number (new stupid parking charges).
But i got a parking penalty 2 weeks later. And i called the driving range, to be answered by a rude arrogant staff member who would not help me to get my parking charge reversed, even though I had evidence of over 100GBP spent with this place in sports & drinks. Great experience. I have stopped going to this driving range anymore

Yes! This is the exact place, it's ridiculous.

Looking at their other parking reviews it would appear that everybody is getting their appeals denied. Am I really going to have to fork out?

You could try something like this to the drving range...

On (date) I visited your driving centre, and purchased 200 balls for £xxx.
I enjoyed my visit and was looking forward to future visits.

However i was then subsequently issued a parking charge notice from your agents, parking eye, PCN ( number) issued to vehicle ( reg number)

I have since been aware that a member of staff was supposed to register my vehicle details upon arrival - this didn't happen.
please ensure that you instruct your agents to cancel this pakring charge notice with immediate effect.
I look forward to your response, and a speedy resolution of tis issue, thank you ( your name)

Send the complaint but do not miss the PoPLA appeal deadline, or leave it to the last minute if this isn't cancelled in time.

Read post 3 of the NEWBIES and start constructing a draft appeal now just in case. Post it here for checking before you submit it.

Get pics of the site and signage in readiness.

Also complain to your MP about this unregulated scam as well as the MP where the alleged event took place. Point out to the latter that this has put you off spending money in their constituency and you have since found that far too many people have suffered the same dreadful experience.
