Appeal ticket if I didn't actually pay?

Can I appeal a parking ticket if I didn't actually pay to park? I parked up in a private car park for 30 mins to go to a dessert place nearby not knowing they had anpr. 11 days later I've got a fine for £85 or 50 if paid in 14 days. I know I was in the wrong but surely £50 is too high? I assumed they had some sort of pay and display but thought as it's night time and there's other cars without tickets I could park without issue.
It is highview parking in Marsh Street Carpark Hanley

    At the top of this board is a thread that tells Newbies to read it first. In that thread is a template, in blue, for you to send.

    Follow the instructions on how to send it and Highview will cancel the ticket.
  • Yes I have read it but I've got no justification to be appealing it so was wondering if it would be different others had slight justification - bought ticket overstayed, unclear signs etc

    You appeal as Keeper , Highview do not comply with POFA so no keeper liability , it's that simple

    Appeal online as keeper using the blue text template from the newbies faq sticky thread near the top of the forum , no blabbing about who was driving or what happened

    You have two choices then. Appeal with the template and they will cancel it or don't appeal.

    If it's a moral judgement then that's your call.

    Before you submit it make sure the drop down box does not say you were the driver. Email it if possible.

    You have the justification that the industry operates an 'outrageous scam' (Hansard) and on moral grounds you are NOT planning on funding Highview.

    Especially when you KNOW they will cancel on one appeal!

    Beating ALL parking firms, is the moral high ground here.

    Highview give you two options - do not choose ''I was the driver and/or...''.

    Re PCN number:

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a formal complaint about your predatory conduct to your client landowner and to my MP.

    There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require ALL photos taken and an explanation of the allegation and your evidence, i.e.:

    - If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.

    - If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner. If you fail to evidence the actual grace period that applies at this site or suggest that only one period applies, this will be disregarded as an attempt to mislead. In the absence of evidence, it will be reasonably taken to be a minimum of twenty minutes (ten on arrival and ten after parking time) in accordance with the official BPA article by Kelvin Reynolds about 'observation periods' on arrival being additional and separate to a 'grace period' at the end.

    - in all cases, you must include a close up actual photograph of the sign you contend was at the location on the material date.

    Formal note:
    Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service in the future.
