PCN from NCP (national car parks ltd.)

Hi,
On 22/12/2019 the driver parked on NCP parking. Because it was before the Christmas, there was plenty people in front of paying machine. I stood up for 15 min to buy a ticket. My Wife went for shopping and when i got a ticket I called her to find out where she is. That's the reason why I know how long I wait. I have time in my logs. 15 days later on 06.01.2020 i got a PCN to keeper that I overstay for 13 min and I need to pay 60 pounds.... !!! Unfortunately I don't have a ticket from the machine :(

Is your Template appeal for BPA or IPC members enough?

    Yes use the blue text appeal , appealing as keeper

    Then check out the CoP and grace periods

    Edit your first post to remove any hint of the driver.

    (The NTK arrived too late to comply with POFA; assuming you meant 2020, not 2010.)

    15. Grace Periods
    15.1 Drivers should be allowed a sufficient amount of time to park and read any signs so
    they may make an informed decision as to whether or not to remain on the site.
    15.2 Drivers should be allowed a sufficient amount of time to leave a site after a pre-paid or
    permitted period of parking has expired

    Check the previous CoP that applied last month , reading section 13 about 2 grace periods ( you need the CoP that applied at the time of the incident , not the new one )

    No need to wait to appeal then

    Tell him no blabbing about who was driving , no stories

    Just appeal as keeper using the blue text template , no need to wait , then look at apcoa popla appeals over the last 12 months and adapt one for when he gets a popla code

    Frustration of contract also applies , due to it being a busy car park , delays in paying and exiting , so the keeper is appealing as an occupant o the vehicle , so knows the back story
  • Sorry but I'm a bit confused. If the first PCN was via the post (ie no windscreen PCN), then they have 14 days in which I should have received ??
    If I got it on 6.01.2020 than its one day too late? Is it 14 working days?

    Just 14 actual days , the day it happened is day zero , has to arrive by day 15, otherwise it fails POFA and so no keeper liability
