Amazon Not Honouring Price

Hi there,
Just wanted some help on a item I purchased on amazon. I paid for the item in the early hours of morning, I then recieved a order confirmation, in the morning I recieved s despatch confirmation, and about two hours later I recieved a email from a third party seller saying then cannot provide item at that price. I looked through all the terms and conditions and its says

Dispatch Confirmation and corresponding dispatch will conclude a separate contract of sale between us for the product(s) specified in that Dispatch Confirmation.

I spoke to citizen advice and they say this acceptance of a contract and they should provide the item at that price. I spoke to amazon and they said the company should honour price on two separate calls. The seller responded there is no law and refunded the money, which I didn't ask for, since then amazon said they would file a claim against them and contact me in two days, they didnt and there saying now theres nothing they can do.
Where do I go from here, if anybody has any ideas that would be brilliant.

    Was the price clearly a mistake e.g. £20 instead of £200?

    If so, then they do not have to honour it.

    How much of a loss of bargain are we talking about?
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    looks like you need both parts to form the contract. They have sent the confirmation but not dispatched

    Amazons own terms state
    "Despite our best efforts, a small number of the items in our catalogue may be mispriced. We will verify pricing when processing your order and before we take payment. If we have made a mistake and a product's correct price is higher than the price on the website, we may either contact you before dispatch to request whether you want to buy the product at the correct price or cancel your order. If a product's correct price is lower than our stated price, we will charge the lower amount and send you the product."

    If it was a 3rd party seller (and your post suggests it was) then it is not Amazon that is not honouring the price.
  • With it being OP's first post......you just know its going to be an expensive £1000 item for £100 or £99 for £9.99

    Exactly my thoughts ... OP, you have no claim - the seller can rescind the contract.

    How much did you pay and how much are they saying the item should have been/how much is it normally?

    I am assuming it was a £10,000 TV marked at £100
  • The price was 20 for a 230 brand new item, which at the time I could of one won for 90 off Ebay virtually brand new. I think it is more cause I lost in both directions and from day one amazon stayed they should honour price on phone and confirmed this in emails twice. Probably my argument is with amazon for there approach to the whole system, especially when they said they would file a complaint against the third party and get back to me in two days which they never did lol

    That's clearly a pricing mistake, so they can cancel due to it being a 'unilateral mistake'. Despite what Amazon say, they are not selling the item, so can't force it to be sold at the incorrect price.

    As it is a 3rd party sale, you have no actual comeback on Amazon.

    But you are talking about a Marketplace seller. NOT Amazon.
    Unless Amazon can force the seller to honour the price, then you have no chance.
