Harveys Furniture Cancellation Unreasonable

Synopsis
Signed a finance agreement for a dining table and 4 bar stools with Harvey's. I don't want the bar stools. Nothing is delivered yet.



Detail
I signed a finance agreement with Harvey's on 18 Dec (3 weeks ago) for a dining table and bar stools. I was told to expect delivery at the tail end of January. I seen different bar stools that would fit my home a lot better. All in I am spending £2,400 on a dining table and bar stools and I want the bar stools off the order (bringing it to £1,800 for just the dining table). I also purchased a couch at the time (£600) so have spent £3,000.


Harvey's say they can change the order but would charge us 20% (£480) for an admin fee to cover costs. Remember that nothing is even delivered at this point. The online agreement says the order can be refunded up to 14 days after delivery but this was in store and subject to different terms.


I have also contacted the finance company who have said they are fine with the terms being changed as they would just make any amendments to the finance agreement.



My questions are:


Is this unreasonable charge to amend my agreement?

Is this in violation of my consumer rights due to the fact I haven't even received anything?

  • There is no breach of your consumer rights here.

    As you made the purchase in store, you have no statutory right to cancel or amend your order and you are reliant upon whatever the terms and conditions stated in the contract of sale and any notices in the store state.

    £480 sounds a lot for admin but ultimately you have no right to cancel so no consumer rights issue.

    £2400 on a table and chairs that you need finance to afford?? Why not just spend £100 on a decent second hand one? Much more MSE!

    The charge seems high, especially if it's a percentage of the entire order and not just the part you're amending (removing). I presume that the charge is there because items are made as they're ordered, so their argument would be that bar stools are now being produced for you which would have involved costs that may be more or less than the £480 they want to charge you.

    I assume the sofa was a separate purchase, otherwise the 20% charge might be as high as £600. However, if those are the terms you agreed to at the point of order, in person, I can't see you can argue. What you could do is ask why the 20% isn't calculated on the value of the bar stools only.

    I don't see any violation of your consumer rights. You've ordered something in person and formed a contract. You have no right to a change of mind return.

    Were the bar stools bog standard 'take it or leave it' - or did you select a fabric/leather seat cover? If the latter, then the charge seems fair as they are unlikely to be able to sell the stools at full price.
