    Is this to repay a loan ? If it is then you can't just ask the bank to refund you whilst you try to negotiate with the issuer ! It doesn't work that way, even if you had been refunded you are still contracted to pay the amounts as per your agreement, whether you are having a hard time or not. You need to speak to Payment Assist, not Halifax. Closing your account with Halifax will just result in you being pursued by Payment Assist for the payments, possibly by taking court action against you.
  • So, Hannah, is it true that you have borrowed money and these are in fact 'loan' repayments? Can you also confirm that we are indeed talking about repayments via your Debit Card and not Direct Debits? - I see you've used the phrase 'recurring payment authority' which does suggest a card-based payment, but confirmation might help my understanding a bit more and it could alter your rights to a refund.

    You also need to tread carefully here because failing to repay a loan 'as agreed' could have serious consequences for your credit file. I see you have said you do intend to pay but not when times are hard - that is understandable, but, if the purpose of the loan was to get you through some hard times in the first place, that approach is somewhat ironic.

    You are now at risk of breaching the contact with the loan company, but, as things stand, your contracted payment has gone out and you are not in breach of contract just yet.

It would be like me having a direct debit to my credit card and then cancelling it. The bank cannot require me to speak to the company first. I have not once said I wouldnt repay it. If you must know my partner is very ill and we are currently running on just my wages alone. We have a house to pay and this is hardly the top of my list to pay.

    The loan was NOT to get me through hard times. It was to fix my car and happened before the hard times came. I have used the company a number of times in the past and have always paid them. I would never take a loan out or a payday loan or a credit card I couldn’t pay back by choice. If you need to know what payment assist is, it’s useD by car garages. I would have been out of my job and even worse off right now had I not fixed my car before these issues arrived. I do hope that people commenting here have never had to go through financial issues before and had to reduce their payments to companies. I have had my credit card for 10 years and they have been fine with reduced payments for a few months.

    It doesn’t alter my rights to a refund. If your direct debit were to go out after cancelling you’d expect a refund, this works the same. Please read the FCA rules.

    I think (but am not sure - please enlighten me someone) there are differences between an Instalment Payment Plan and a Recurring Transaction. Whatever the case, your bank may be able to cancel the payment instruction and give you back your money but that doesn't necessarily release you from the contract you have entered into. You may be pursued by the company for payment by alternate means. Have you cancelled the contract with the actual company involved?

    Correct. If a customer asks for a regular payment to be stopped we have to action it.
    Thing like payday loans & fixed term instalment plans etc all have to be done.
    But while we do it, they are advised that we are only stopping the payment at our end and that the retailer can pursue them via other means.
    Stops them complaining to the bank when they get a debt collection letter.

    The fact that you had to use a loan to fix your car several times shows your finances were out of control before partner became ill. It's a shame you didn't try and sort out your fiances the first time you had to use a loan and then you could have saved up an emergency fund for car repairs and you wouldn't be in such a dire financial situation now !.

It’s a shame people like yourself and others who have commented have such down looking opinions and appear to know everything but actually know nothing. I came to this forum for advice. But it appears these forums are just a shaming game.
  • Also, I am not in a dire situation. I do have money and all my bills are up to date apart from that one. So do not make assumptions. I have a well paid job and friends and family. That’s all I need. I will no longer be replying to anyone else. The first few people who commented have good advice and thank you to them. Everyone since, shame on you and get a life.

    I don't think it is excessive really. The OP is asking about a complaint situation with a bank (in which she is completely entitled to a refund). It's clearly inappropriate and potentially offensive to start criticising the OPs financial management skills and financial decisions, with no context on those decisions and when no advice was asked for.
