    The CoP cant do anything aboutthe courts. 
  • Congratulations to Turbocat (and yourselves) on winning using the Abuse of Process.
    So I have my day in court with VCS in a month or so.   Can I point this example out to the judge as part of my defence in court?  AoP was included in my courty bundle but the Judge has not taken it on board as far as I can see.

  • I lost.

    In court this morning and, basically, I did not convince the judge that a phone reset was an emergency.  In his reasoning an emergency was a catastrophic engine failure or passenger having a hearty attack.

    No joy either with "sign not facing oncoming traffic and so was not readable" argument.  If a sign (with T&Cs) was there than that is good enough....  Note. The signage and markings on the site has been beefed up a lot since my incident.

    The judge also said that the case that had been thrown out because of the ‘abuse of process’ (Southampton, judge Grand) had recently been successfully appealed and was binding on him.

    I did get £19-00 expenses (1 hour) for attending the telephone hearing that the PPC failed to organise when ordered to by the court.  It was the same judge!  The Judge said he was minded to throw it out ……. as I already knew at that point in his summing up that I had lost, I therefore felt a bit unlucky.

    The £60-00 (extra) was thrown out by the judge.  So £131.00 to pay.  (£150 - £19)

    An interesting experience but one I shall try not to repeat.

    For anyone who has stopped at an airport and been penalised may I wish you great luck or a rock solid argument if you take it to court.

    A big, big thank you to everyone on this site that helped me with this case.  Your help was very much appreciated and invaluable.  Coupon-mad you were awesome, thank you.  

    Apologies for losing  ;)   I did not realise how much I would have to counter the Judges views. I believed I would be arguing with the PPC (appointed) representative.   I was unable to put up a good counter argument and could not change his view point.

    Good question, what is a phone re-set?

    Also what happened when you bought up airport by-laws ( assuming you did and they apply at that site) and then contested jurisdiction as a result?
    From the Plain Language Commission:

    Inthink hat this judge needs to be called to task.  Perhaps a letter to his/her line manager would suffice.   One should not have to pay a fee to complain about an incompetant public servant.  Have you complained to your MP?
