A quick update on what should have been my tel hearing......
    1. Court ordered claimant to arrange BT call me meeting.
    2. I heard nothing
    3. I emailed the court a few days before to say I had heard nothing. They sugested I contact claimant! I did not.
    4. On the day I heard nothing emailed court and then phoned them to say I was available. They had not heard from claimant.
    5. Court contacted claimant to say hearing would be rearranged  in 30mins.  Claimant said they did not want the expense of the call. (they wanted it on papers I believe).
    6. Apparently Judge thought about it.
    7. The Court wrote back a couple of days later to say it would now be adjourned and will be relisted for a face to face hearing when restrictions are lifted. Court wanted to know my availability over the next 3 months....
So all on hold.  If the court had arranged the call then this would have been over by now.  I'm all prepared so its just a matter of waiting now as far as I can see.

Times must be hard if they can't afford the cost of a phone call.  Pity the Judge didn't kick them into touch at this stage. Maybe he won't be too chuffed with them when it comes to an actual hearing. Get thinking about their unreasonable behaviour and started preparing your Summary Costs Assessment (@£19 ph), you might be pushing at an open door with the Judge.

I did wonder if the Judge would throw it out.
I'll have to update and increase my Summarry Cost Assesment as I'll now have petrol and car parking costs to recover. :)

Time costs are the important ones - make sure you're logging all the time you're having to spend on this as a result of their tomfeckery.

Ask for your wasted costs. You "attended" the hearing, the claimant didn't.

IMO not contacting either you or  the court is unreasonable behaviour, I hope you did not cancel something important to be at home.

This so infuriates me, two completely different sets of rules.  If you had been the one who failed to try to attend or not given phone number to claimant, there would have been a default judgment issued.  This sort of issue  has been posted on forum recently.

Can the new CoP force the courts to apply the law equally to everybody?
